In the action, the plaintiffs sued to recover $600," the complaint containing two counts with each based on the same transaction. For the defendant, At- torney Frank P. Rohrmayer made a special defense, charging that the contract under which the plaintiffs €ought to recover was tainted with fraud. The jury entered a verdict for the plaintiffs to recover $250 under the first count and for the defendant under the second count. Under the later ruling it was interpreted that, Unless fraud was found - under the second count there was no ground for the jury to reach such a verdict in the part of the action brought under this count.
