No Alcohol-JustBload-Food Scott & Bowne, Bloomfield, N.J. 16-26 Burke, a member of the firm of Dege- ner & Burke, had been suspended for one year by the board of governors, charged with violating that section of the constitution prohibiting ‘“‘conduct or proceeding inconsistent with just and equitable principles of trade.” The specific offense charged against Burke occurred on Dec. 20. On that day, according to a statement issued by the exchange, he sold at.the bid price of 12, through another broker, 100 shares of Union Bag and Paper common stock as a basis for obtain- {ing 420 shares of the same issue in various odd lots from three dealers in odd lots of 12 1-8. It is customary for the dealers in odd lots, or lots under 100 shares, to execute market buying orders at an eighth above the last previous price for 100 shares. and selling orders at an eighth down. There had been no transactions in Union Bag and Paper for some time, and by selling a full jlot at 12 Burke established the price at which the odd-lot dealers had to ! fulfill their orders for that issue. The sale was not bona fide. in that it was intended merely to lower the price at which the seller was enabled to pick { up the odd lots. Burke was called be- fore the committee for trial on Wed- nesday, offered his defense, and was found guilty. It was said that a customer of Deg- ener & Burke placed orders for 420 | shares of Union Bag & Paper, in odd lots, which were turned over to the dealers for execution. He then 'or- dered 100 shares sold at 12. The mar- ket was 12 bid, 12 1-2 asked, and it was alleged by the odd-lot men that instead of offering his 100 shares at the hest price obtainable, Burke in- isted on getting exactly 12. Brokers said the manipulation charged against Burke was not an ex- treme case. and he did not profit by it personally; but the governors held that he should have prevented a cus- tomer from abusing the privileges of the exchange. Burke's failure to of- fer the full lot of stock at the best price was held to be inexcusable. It is a cardinal rule of trading that a broker must endeavor to obtain the highest price possible for stock he is commissioned to sell and the lowest quotations for stock he is to buy. In arbitrarily demanding less than other brokers were willing to bid he in- vited the suspicion of the odd lot dealers. CONSTITUTION OF MEXICO IS UNFAIR | Secretary Lansing Points Out Un- just Clauses to Carranza Mexico City, Jan, 26.—Secretary of State Lansing has sent to Carranza through Charles B. Parker, American charge d'affaires a in regara to provisions which it has been proposed to include in the new Mexican con- stitution. The communication to the article vesting the executive with power to expropriate property without judicial recourse, and also to the article providing that civil and commercial companies not own properties of a greater area than is necessary to accomplish the purpose for which they are formed, and placing the power to determine what area is necessary in the hands of the executive. The communication says that if the latter provision were made retroactive it might be confiscatory, as no provision is made for compen tion. Attention is called to the article providing that there be no exemption from taxation. If this were given a retroactive effect, says Secretary Lan- sing’s communication, it would impair contracts of many foreign corporations here, communication certain calls attention or bilious children a whole Cascaretnow operating under agreements pro- viding periods of exemption by thc Federal or state governments, General | Regarding Article 33, dealing with the expulsion of obnaxious foreigners, objection is made because the pro- posed article permits the executive to expel any one, without recourse to appeal, whose presence is deemed in- advisable by him. The letter states that this is not in accord with the usual practice of nations, that cause be clearly shown. Mr. Parker has alsa sent to General Carranza a statement from Secretary Lansing protesting against the posed article in the new constitution which stipulates that special conces- sions must be obtained by exploiters of oil lands, and allows companies now owning such lands one year in whick ta secure new concessions in order to protect the rights already acquired. The protest delivered to the for- cighoffice in Mexico City today againd¥ incorporation in the new con- stitution. of provisions limiting prop- erty holdings of foreigners and pro- viding for other restrictions of the rights of foreigners was made after the receipt at the state department of numerous complaints from Amer- icans with property in Mexico. En- actment of such constitutional pro- visions may prove cause for diploma- tic entanglements, not only with the United States government, but with other governments whose nationals have invested in Mexico. Secretary Lansing’s protest against the adoption of a provision for con- fiscation of property was based on the proposed article in which it is stated: “Private property shall not be seized for public purposes without compensation. The need of utility of such seizure shall be determined by ing and snuffing. Thi executive shall in every case deter] mine this area.” Protest against another article wa: caused by the addition to the old con. stitutional provision that *‘there shal be no private or government monopo lies of any sort” of the words, *“no: exemption from taxation.” This ad dition was aimed at concessions, al. most all of which have in them pro vision for certain exemptions fo varying periods. 7 Objection to a change in the pro-| visions for the expulsion of foreigners| was caused by phraseology that ap- pears to permit of no opportunity for| the accused to show cause why ho should not be expelled. The pro- posed provision reads: “The executive shall have the ex- clusive right to expel from the re- public forthwith and without judiciall process any foreigner whose presence he may deem inadvisable. Any ac- tion taken by the executive under this authorization shall be without appeal. “No foreigner shall meddle in the political affairs of the country. Nor shall they acquire any real estate un- less they shall have previously de- clared to the department of foreign affairs their intention to waive their citizenship and the protection of their respective governments in all matters pertaining to the said property and to accept the jurisdiction of the laws and authorities of the republic in so far as the property is concerned.”
