Mr. Nelson told the court that because of his father-in-law's intem- { perate habits his mother-in-law has had to leave him and seek refuge at his home. Sunday afternoon Roth came looking for his wife and after being admitted to the house raised a disturbance by swearing and threat- ening to kill Nelson. Wilson Bottom- 1y, another son-in-law of the accused, testified that Roth made an attempt to strike Nelson with a heavy cane and would have done so had he not interferred.
