Tierney, Deacon Murphy, and Huntington Merchant at luncheon at the Hotel Belmont, insisted that while he wanted a speedy trial if he was to stand trial at all, he first wanted the legality of the indictment tested before consenting to defend himself against the charges. An appeal would go before the Appellate Division in Brooklyn if it should be found that the higher court had jurisdiction to receive an appeal from Justice Mors- chauser’s order. “If the order is appealable on ap- peal will be made at once,” said Mr Battle last night. “As yet we are not certain that the Appellate Division has jurisdiction to comsider it. If jg is found possible to take the matter before the higher court, we feel sure, from the evidence we can submit, that a favorable decision will result fo. the defense. We shall determine to- morrow whether or not to make the appeal. “Our appeal would be based on the grounds that the whole proceed- ings taken against Warden Osborne were based on illegal and incompe- tent evidence, and that certain ques- tions asked by the Grand Jury and the District Attorney of Winchester county indicate bias and prejudice against our client.
