Man- ton charged that many of the state- ments printed in the newspapers re- garding the Becker case were false. Justice Seabury after declining to start the inquiry told Manton to file affidavits with him embodying the objectionable articles. Manton did not show any inclination to do this and 'hinted that he would take the matter to Governor Glynn. The question of the inquiry came up immediately after Mr. Whitman had made his motion for the special panel. Manton concurred in that motion and then said: “Certain articles are appearing in the public press, particularly this morning. These articles charge the defendant with purchasing testimony, or/Have that insinuation. They have other false statements. One article is a quoted interview with the dis- trict attorney. False, Says Becker's Lawyer. “Since the charges are false, since this defendant has been tried before and since the court of appeals has the of said he has not had a fair trial these charges should be called to your at- tention on the eve of the second trial for proper action.” “I cannot see,” replied, Justice Sea- bury, “that the decision of the court of appeals has any reference at all to the subject matter of your re- quest.” Mr. Manton insisted that Mr. Whit- man must have authorized the state- ment attributed to him. “I cannot assume,” said the court, “that the district attorney has -made a statement to the public press which is ‘not true, and in the absence of any such proof I certainly .should not indulge in any such assumption.” Mr. Manton protested that the pub- lic was likely to be unfairly influ- enced by such statements or publica- tions. Justice Seabury then told the lawyer to file affidavits. Mr. Manton on leaving the court room said that he meant to take the matter to Governor Glynn. “The prosecution,” he said, “is trying to create the impression that we are not ready for trial. That also is not true. .Becker will be acquitted at the next trial and he will be free before Decoration day that he may decorate the graves of his baby, his mothér and his mother- in-law.” Becker -May Not Go on Stand. Asked if Becker would take the witness stand he said that such course depended entirely on the evi- dence presented by the distric attor- ney. “If the same evidence,” he said, *is presented we will not put him on the witness stand because the court of appeals made it clear they regarded the chief witnesses as liars.” District Attorney Whitman had an- other talk yesterday with William E. Burwell, one of the two men who committed perjury in the attempt io save the four gunmen from execu- tion for the murder of Herman Rosenthal. | Burwell seemed eager to add to his confession, Although the man is being closely watched he has not been placed under arrest.
