McCormick and wife, the latter being formerly Miss Mary Butler, accompanied by their little son Lester and Miss Estelle Butler, of Fort Meade, are spending a few days in Lakeland with their mother. Mr. McCormick made the trip in his machine—a distance of 115 miles in one day, arriving in Lakeland at 7 p. m. Friday none the worse for the long trip. Mr. Mc says Lakeland is all 0. K., but he prefers the beautiful banks of the Caloosahatchee, where all is quiet and serene; where the herds of cattle roam at large and the wild flowers bloom in profusion with nothing to break the monotony but the shrill blast of a passing boat. Yes, Dan, all's quiet and serene until a few of those convicts escape, and then listen! Come to Lakeland again, Dan, we are always glad to see you. A FRIEND. TRAIN ARRIVED THREE YEARS LATE. A train which left Bolivar in South America for a neighboring town three years ago has just ar- rived. The distance covered was 120 kilometers, and the reason for the delay was a storm which derailed the train, killed most of the passen- gers and ripped up such a goodly por- tion of the railroad line that the company owning it was forced into bankruptey. About six months ago an American engineer undertook the reconstruction of the road and brought the long delayed train to the point for which it originally started.—Harper's Weekly. THE REASON. James Whitcomb Riley used to tour the country with Bill Nye in lecture courses. One night while the two were behind the scenes in the theater of some eastern town Riley got tired of waiting while Nye tried to make himself beautiful, and tip- toeing to the drop curtain peered out into the auditorium. Be it ordained by the Council of the City of Lakeland. ~ tion 1. That William R. Peters, ates, successors and as- E individuals or as a body cor- porate or to become corporate, under pany, are hereby granted the rights and privileges to erect gas works, and use the streets, avenues, lanes, sidewalks, public places, squares, bridges, viaducts and streams of the City of Lakeland, for the purpose of laying down in the said streets, avenues, lanes, sidewalks, public places, squares, bridges, viaducts and streams, pipes for the purpose of conveying gas in and through said city, for the use of said city and its inhabitants; and said rights and privileges shall continue and be en- forced for the term of thirty (30) years from this date. The above franchise and privileges are granted upon the following condi- tions, to be kept and performed by the Lakeland Gas Company, to-wit: Sec. 2. That the Lakeland Gas Company shall within a reasonable period from this date begin the con- struction of a first class gas plant, with the best modern devices and im- provements for generating gas of the capacity to equal 150,000 cubic feet each twenty-four (24) hours, and more if the needs of the city and its inhabitants require; and to provide suitable conductors and mains in size and quantity for the equipment of the city with a first-class gas plant, and that the same shall be built, constructed and erected com- plete within twelve (12) months from this date. Sec. 3 That the Lakeland Gas Company shall furnish gas for fuel, power or lighting purposes to the citizens of the City of Lakeland at the rate of One Dollar and Eighty (‘ents ($1.80) per thousand cubh-[ feet, with a discount of ten cents (10 cents) per thousand cubic feet it paid on or before the tenth (10th) day of each and every month following that month for which bill Las been rendered, which rate shall apply to gas for fuel purposes only; and at the rate of One Dollar and Eighty-five cents ($1.85) per thous- and cubic feet, with a like discount as aforesaid, which rate shall apply to gas for illuminating purposes only. Said gas shall have a candle power of twenty (20) by test at the plant. The Lakeland Gas Company shall reduce said rates from time to time as the increase in the yearly output of gas, considered in conjunc- tion with the cost of material, trans- portation, etc., shall appear to war- rant; provided, that the said Lake- land Gas Company shall not sell il- luminating gas within the City of Lakeland, for the first eight (8) years of its operation at a lower price than above authorized, without the consent of the Council. Provid- ed further, that the Lakeland Gas Company shall not at any time sell gas for fuel or power at a higher rate than above authorized, but shall not be restricted in selling it at ¢ lower rate, if they find it reasonable to do so. Sec. 4. That the said Lakeland Gas Company shall lay and extend its mains wherever the number of new consumers to each contiguous city block shall average one new consum- er for every one hundred (100) feet of main necessary to lay said block. Sec. 5. It is also further provided that all excavations made by the Lakeland Gas Company shall be made with the least possible incon- venience to the public, and that the Lakeland Gas Company shall leave the streets, avenues, lanes, alleys, sidewalks, public places and squares, bridges, viaducts and streams in as good condition as they were in before the excavation and shall repair at their own expense any settlement over the excavations on any street or public way within one year after laying the said main; and that the Lakeland Gas Company shall main- tain during the night time red lights or signals at all excavations made in the City streets etc., and shall be responsible for all damage caused by any excavation made. Sec. 6. It is expressly ordained that a temporary failure to perform the conditighs of this contract, should failure be caused by accident quarantine or other causes not with- in human control or the control of the Lakeland Gas Company, shall not work a forfeiture of the privil- eges herein granted. Provided al- ways, that the work shall be pro- gressed with for a reasonable time. whereof the City Council shall take cognizance, and make such exten- sions of time as may, in its judg- ment, be reasonable and just. Sec. 7. That when the amount of gas consumed goes above twenty mil- lions of cubic feet per annum, the said Lakeland Gas Company shall pay to the City of Lakeland, three cents (3 cents) per thousand cubic feet until the entire consumption of its gas reaches thirty-five million cubic feet per annum, and that after the consumption of said gas goes above thirty-five million cubic feet per annum, the said Lakeland Gas Company shall pay to the City of Lakeland four cents (4 cemts) per thousand cubic feet on all its gas con- sumed within the City of Lakeland until the amount reaches fifty mil- lions of cubic feet; and that after the amount reaches fifty milfions cu- bic feet per annum, that they shall not be required to pay any part of its earnings to the City of Lakeland for the gas consumed within the City of Lakeland over and above fifty million of cubic feet per annum. Sec. 8. It is further ordained by the City of Lakeland that this ordi- nance shall extend and apply to all extensions, additions or enlarge- ments of the ity of Lakeland. Sec. 9. It is also expressly or- dained by the City of Lakeland that no privilege shall at any time be given to any pther gas company by the City of Lakeland, unless upon the same conditions as are herein <.ontainvd. unless the Lakeland Gas Company shall be granted equal privileges. The City of Lakeland expressly re- serves the right to purchase property of the Lakeland Gas Com- pany, in its plant and fixtures at the expiration of this franchise, for its fair market value, to be ascertained by competent engineers in this line of business.
