McCarthy’s Happy To Get “Circus” Over With By JOHN CHADWICK told newsmen he was “very happy to get this circus over with.” oti? fa Democratic leader, Sen. Lyndon Johnson of Texas, President Eisenhower declined comment on the Senate’s action at his news conference yesterday. He said it was a matter of the Senate determining what is re- quired in preserving its dignity. No one else is in it, he said. The resoluton, as adopted by the Senate in its final form, con- demned MeCarthy’s conduct on these two counts: 1, That -he had obstructed “the constitutional processes of the Sen- ate” by failing to cooperate with and by repeatedly abusing a Sen- ate elections subcommittee and its members in their investigation of his financial affairs n 1951-52. 2. That he “acted contrary to senatoral ethics ani tended to bring the Senate into dishonor and disrepute” by his attacks on: the special committee that recom- mended his censure and by calling the Senate’s special session, other things, “a lynch party.” The second count, offered by Bennett, was adopted in place of a count recommended by the spe- cial committee to condemn Mc- Carthy for “intemperate abuse” the | of Brig. Gen. Ralph W. Zwicker. The count based on McCarthy’s treatment of Zwicker at a closed- door hearing in New York City last Feb. 18 was never brought to a vote after strong opposition to it became evident in the debate. Bennett’s count was substituted in- stead by a 64-23 vote, and then approved 6424. Sen. Flanders (R-Vt), author of the original censure resolution against McCarthy, after the final roll call that “this has been a long and sad, but very neces- Sary éxperience.” He said he be- lieves that from now on “‘it will he possible to have a more con- structive approach to fighting com- munism. Sen. Watkins, chairman of the | special committee, said ‘‘the Sen- condemnation. McCarthy referred to the Sen- ate’s attion as “censure” more than once in talking to newsmen, despite some controversy in the Senate itself.as to whether he had been censured, Bridges raised the question after the vote,-to the accompaniment of broad smiles from the McCar- thy backers, He asked Vice Presi- dent Nixon if the word censure appeared in the resolution that had been adopted. Nixon told him it did not and said that without objection the title of the resolution would. be accordingly amended to delete the word censure. The final title thus tead: “A resolution relating to the conduct of the senator from Wis- consin, Mr, McCarthy.” However, Nixon declined to pass on whether the resolytion cen- sured McCarthy. He said senatozs could place their own interpreta- tion on it, Watkins said he considered “condemn” an even stronger word. So did Sen. Stennis (D-Miss), an- other member of the special com- mittee. ~ But Sen. Case R-SD), a third member of the committee, said he thought “censure” was stronger than “condemn.” The use of the word condemn was in line with the last previous case before the Senate when in 1929, a resolution was’ adopted io “condemn’ the conduct of former Republican Sen, Hiram Bingham of Connecticut for bringing a lob- byist into a closed hearing on tariff legislation. The only prior case, occurring in 1902, involved a fracas on the Senate floor between two South Carolina senators. In that instance the Senate adopted a resolution using the word censure against both senators. Both of these earlier cases, pro- viding the only Senate precedents, as censure cases. Oddly enough, a careful reading of the resolution does contain the word censure in that it refers to “the select committee to study censure charges”—the special bi- partisan group headed by Watkins. The vote to condemn McCarthy’s conduct did not strip him of any of his rights and privileges as a senator. Nor did it deprive him of his chairmanships of the Senate government Ooperations Commit- tee’ and its investigations subcom- mittee, although he stands to lose these when the Democrats organ- ize the Senate in January. The vote was an official Senate rebuke for his conduct. Ful- bright (D-Ark). : These were referred to the Wat- kins committee, especially set up by the Senate to handle the case, and it recommended after public hearings that McCarthy be con- demned for his conduct toward the elections committee and Gen, Zwicker. Zwicker, former commanding of- ficer at Camp Kilmer, N.J., was questioned by McCarthy about the promotion and honorable discharge of former Army Maj. Irving Per- ess. Peress, a New York City dentist, refused to answer questions about any Communist connections when he testified before McCarthy’s committee, just as he had when filling out an Army loyalty form. McCarthy called him “A Fifth Amendment Communist.” McCarthy, in questioning Zwick- er about the case at an investiga- tions subcommittee hearing ‘ast February, told the much-decorated general he was not fit to wear the uniform. The special committee said Zwicker could not give the infor- mation McCarthy wanted, because of orders from his Army superiors, and called McCarthy's treatment cf the officer “inexcusable” and “reprehensible.” But when this count was brought up in the Senate yesterday, ‘sev- eral influential senators made clear they felt the Army had acted improperly toward the Senate :n- vestigators in its handling of the Peress case and they would not support the committee’s recom- mendation to rebuke McCarthy. In the face of this opposition, Watkins agreed to a move to sub- stitute the count proposed by Ben- nett for the Zwicker count. McCarthy made his “unwitting handmaiden” remark in a speech he never delivered but which he put in the Congressional Record after giving advance copies to the press. Other statements of his re- ferred to in the Bennett count were made on TV programs or in news- Paper interviews. Sen. Walker (R-ldaho), one of McCarthy’s strongest supporters, Protested that the count offered by Bennett was being acted on with- out being referred to committee for study. | But when Sen, Daniel (D-Tex) asked if there were any denial of the facts it set out, Welker said he could not answer. While McCarthy himself stayed away from the Senate floor until just before the final roll call,his supporters held forth for much of the time during the final day of the bitter debate. Sen. Jenner (R-Ind) early in the day delivered an attack on Flan- ders in a. series of questions ask- ing, among other things, about a Possible association between Flan- ders and the late Harry Dexter White.
