Actor Jess Barker, the erstwhile husband, has the family station wagon. This was the decree yesterday of Superior Court, where the ac- tress’ suit was vigorously opposed by Barker. The trial last June in- cluded testimony that Barker threw her nude into the swimming pool at her home, and that. Miss ‘Hayward stuck a cigarette in his eye. Barker received the privilege of visiting the 9-year-old sons on al- ternate weekends. At one point in the litigation he turned down a $100,000 settlement because it would have been paid in $10,000 yearly installments and would look like alimony. Barker wanted half the commu- nity property, but Miss Hayward successfully contended that all this was hers because of a prenuptial agreement permitting her to keep all she earned after their mar- Tiage in 1944. The assets ruled to be hers in- clude a million-dollar movie con- tract and $293,319 in cash. Bark- er’s bank account, it was testified, amounted to about $5,000, and in 1951 and 1952 he earned $665 while the actress was earning $374,068. : The source of their marital trou- ble, Miss Hayward testified, was Barker’s refusal to work.
