No Surprise For Johns In Court Action TALLAHASSEE (#—Acting Gov. Collections, which will have to be refunded if the Supreme Court’s decision stands, have amounted to $2,280,000 in the first 11 months under the act passed. Sixty per cent was earmarked for equal distribution among the 67 counties and the rest for a new program of aid to indigent dis- abled persons. Johns said he will introduce a bill on the first day of the 1955 Legislature to provide funds for the needy disabled. The Supreme Court ruled 43 that the added tax was based on an “arbitrary and capricious” sliding scale rate that violated the constitutional guarantee of equal protection of the law. Atty. Gen. Richard W. Ervin said he will ask the court to recon- sider and one of his assistants said there may be an appeal to the U. S. Supreme Court.
