He said that “50 fef from” ete., was the law. I mi ask him. to inform himself of law. I must ask him to check statements, in one or two respects, before making any. I was angry for due reasons, 1 can raise my voice without being arrested if a loud beer joint cat continue with constant ordinante violation in the same area at the same time. Ey I do not have to air-condition my place to control unreasonable noise from a business invading my pf vacy. Nor would it do any gool, in this instance, as the constast racket coming through all the closed doors and windows this past week has proved. The owner of the business creating the nuisance is| held responsible for his indiffer- }}ence to violations-not his neigh- bor! And to arrest the wrong per- son is a serious error-how serious will be determined if this inex- cusable “official” conduct of an officer confronts me again. I have never heard of any law, anywhere, that makes a citizen liable to ar- rest if he asks an officer to en- force an ordinance. I don’t expect Included with this letter are five pages of paragraphs excerpts from the City Code. All of these have some bearing on “Loud, disturb- ing and unnecessary noises.”” What is this City Code of Key West— a serious, dignified set of rules to operate a growing city, or a comedy script on some Monday Night vaudeville show? The Commissioners “shall have power to pass ordinances and make regulations to secure the general health of the inhabitants of the city,” Chapter C. 2, A. 1, section 2... .“to define, abate, prevent and remove nuisances, whether affect- ing the health or morals of the community;. . ..” This would seem to indicate that the commissioners have the power to enforce exist- ing ordinances as well as pass more ordinances to be ignored for the benefit of the few. The situation cannot be cured by a half-hearted effort, as has been the rule in the past. People, other than myself, are about to get angry. ys This situation is getting to a point where the City Commission will have to admit that it does exist.
