Sullivan Reinstated Sheriff County Study Does Not Show Sullivan Violated Law, Declares Governor TALLAHASSEE, Apr. 9. —(AP)—Suspended Sheriff Jimmy Suilivan of Dade county was re-instated to- day by Governor Warren. Warren said a study of evidence before a grand jury which indicted Sulli- van “does not show the viol- ation of any law of the state of Florida by Jimmy Sulli- van, nor does it show*that he willfully failed to per- form any duty imposed on him by law, or that he act= ed corruptly in the per- formance of any duty im- posed on him by law.” ‘Sullivan was suspended by Warren October 16th, 1950, following his indic- ment on charges of neglect of duty in failing to enforce gambling laws and for per- mitting deputies under him to aecpet bribes. The Florida Supreme Court later held the indict- ment ‘‘void and ineffective” in that it did not charge Sullivan with a crime under the laws of Florida. The reinstatement,-o! Sullivan automati¢ally can- cels the commission. of Thomas F. Kelly, who has been serving as sheriff dur- ing Sullivan’s suspension. They had been spotted by , a Navy plane. The first report of the missing skiff was turned into the Coast Guard last night at 8 o’clock. The bodies were found this morning at 9 o’elock. Coronor Ira Albury identified the bodies as those of Roberts and Hicks. The 4 men had left Boca Chica beach at 2 yesterday afternoon for a fshing trip. John W. Puopolo of the fleet Sonar School had planned to go with the other four, but | decided to stay ashore. He was with Mrs. Hicks and he: ; two children. According to Puopolo, Parker tested the outboard engine of the boat and then the other three men got in. The boat a 12 foot Dumphy, left Boca Chica Beach and said Puopolo: “The current took them out fast and they were out of sight. within a few minutes. “About two hours late I'went to look for them. We drove along the beach. We had made arragements,” he said, “that if they got into trouble they would pull into the beach farther east,, “T couldn’t find them then—that was about 4 p.m ThenJ saw a speck about on¢.mile off the beach, which I thought was their boat. I didn’t think they were in any danger then. “About 6:30 o’clock,” said Puopolo, “I began to worry about them and then ‘ went to look for a boat. “IT went to Mac’s place and tried to get a boat, but he and reported it to the Officer of the Day, Lt. J.P. Curless, who called the Coast Guard and reported the boat over due and gave the position last seen which was one or two miles south of Boca Chica beach. This was about 7:45 p.m. “T drove back to Boca Chica beach and signalled to the Coast Guard boat as requested. We searched. until about 1 or 1:30 a.m. and then called the search off until daylight.” Puopolo for his help. He said that Puopolo used his head- lights to signal the Coast Guard Boat. Search was resum- | ed at daylight by Coat Guard boats and Navy planes. Roberts a single man, lived at Louisa and Whitc- head streets. He is survived by his father, Ernest A. Rob- erts, 532 Grinnell street, his sister Mrs. Aaron Williams, and his niece Mrs. Clyde Hicks. The first body was found by a shrimp boat this morning. Coast Guard boat 83403 took the body aboard a few minutes later. The Navy planes had spotted life jackets off Sand Key. A few minutes later Coast Guard running about three and onc half miles south of Meach- am field saw two men still hanging on to the small skiff, from which the engine had been thrown out to kee: } her afloat. ; : One of the men was yoing down as the Coast guard iumped into the water and swam to the skiff saving the first man and the second man who started to go under as the Coast Guardsman swam toward him. The rescued men were rushed by Navy ambulance to the Naval hos- vital. Usry is still under medication. and treatment for shock. it was reported. Parker is doing nicely, hospital officers said. The bodies of Roberts and Hi¢ks were hrought to the Coast Guard station and identified there. They were | taken to Pritchard Funeral home. % Hicks was a carpenter at the Naval station.
