THE ORACLE GUILTY KILLER MAY ESCAPE An interesting legal situation arises in South Dakota, where « circuit judge has ordered the release of a prisoner convict- ed of killing another man upon the ground that there is no law providing for punishment of a white man who murders another white man on an Indian Reserva- tion. The decision was based on the fact that, in 1901, the South Dakota Legisla- ture relinquished jurisdiction over certain crimes on Indian Reservations. Thereafter the Federal Courts accepted the jurisdie- tian through an Act of Congress but, in 1948, the Federal government gave up ju- risdietion over crimes involving white per- sons only. The South Dakota Legistature, in the meantime, had not acted to restore jurtadiction to the State government The decision of the jurist will prove stattling to those who do not thoroughly underetand that in this free country no man can be punished for an act unless the law has established it as a crim: _ its oceutrence. Consequently, if no court has jurisdiction of the offense, there can he no legal proceedings to punish the in- dividual.
