Judge John W. Holland had trefused to allow as evidence written confessions on the grounds that Watson was not given his constitutional rights. The verbal conversation with his mother, . however; was admitted since it was purely voluntary and he had been allowed the cus- tomary rights of an accused per- son. Foard’s testimony, the most damaging which U. S. Attorney Hayford O. Enwall has brought before the jury, was verified by two FBI agents. Foard testified as follows, regarding the conver- sation between Watson and his mother: “Watson was brought from the brig under marine guard. After they embraced in greet- ing, we left the mother and t the defendant together in the | room, Outside the room, I could hear the defendant's mother screaming, ‘Don’t kill yourself, David. Don't kill yourself. Don’t take your life.” “Tl went into the room. They were talking. He said that the person woke up and called him by name and said, ‘Wat- son, I am going to report you to the executive officer in the morning.’ “He then said he reached around for something and found a wrench and hit him over the head, kept hitting and hitting him, then took a piece of canvas and wrapped it around the head of the person and pulled it tight so he wouldn't scream, wouldn't be so loud—a piece of rope attach- | j Palestine, tinued. tefusal of the British, who; ed to the canvas. The statement is substan- tially the same as that which he gave his mother so far as the act of murder is concerned. Because of the court’s ruling that Watson had not been brought before a U.S. commis- sioner and had been denied cer- iain other rignts, the jury ™ not allowed to listen to Pro: tor Enwall’s reading. He added that he hoped and prayed that, instead, a spirit of wisdom and_ restraint would guide both branches of the gov- ernment in whatever action they may take. To attempt to tamper with the process of government by either branch, he declared, would be against the public in- terest Truman said he accepted, as a good American, the will of a ma- jority of voters in Tuesday's election, and he will be guided in all his acts as president to try to conform with that will.
