As individ uals, they might even favor some of the things whose legality they rule -against, It is eminently unfair to de- nounce the Justices as anti-social be- cause they persist in viewing legal questions from the standpoint of le- gality alone, Viewed, however, through the new spectacles of reform at any price. the Justices are incompetent, old-fash- ioned, and anti-social. In the minds of some present-day liberals. any- thing is justified if thé end seems des sirable. Such are willing to disregard the Constitution and its principles to achieve their purposes. Opponents of the President’s plan point out that from the very begin- ning of the New Dea:. the fundamen- tal pringiples of Federal dualism, enumerated powers. limited govern- ment, and separation of powers have been openly flaunte’. They interpret the present move as an attempt to emasculate the pricciple of judi- cial review by remodeling the Su- preme Court on a paitern better suit- ed to the purposes of far-reaching re« form. This explains why-so many of the President's liberal supporters, who still adhere to fundamental prin- ciples, have failed to follow him. They took upon the present scheme as a disservice to the cause of real reform. They are con- demned because they insist thet they are obligated to use the Constitution and fundamental constitutional prin- ciples as a measuring stick when they pass judgment or. lugislation or ex~ ecutive acts, In the eyes of those who would pack the Supreme Court. it has sinned against liberalism in viewing the recent reform legislation through the spectacles of the framers of the Constitution, rather than through the spectacles of the apostles of social and economic change.
