LUTZ Professor of Public Finance, Princeton University Whenever a government permits freedom of speech and of the press, there will be a certain amount of a tation for the overthrow of that gov- ernment. The remedy is not the suppression of agitators and their subversive doc‘rines but such a thorough understanding of the advan- tages of the democratic sys- tem as will pro- vide complete immunity against these doctrines. When everyone is thoroughly im- munized. the svap-box orator and the writers of | books that extoll autocracy in its vari- ous forms will be clearl. seen for what they are, namely “gould brick” | salesmen. If we should make the mis- take of suppressing them, we wouid thereby lay grounds for a suspicion that there is an element of truth in their nonsense. The antidote for all autocratic and dictatorial poisons is found in the con- stitution. It consists of the rights and privileges that are guaranteed to all under democratic government. Every citizen shourd be familia’ with the rights and privileges that are assured to him in that document He should understand that he is asked to surren- der these rights when he is urged to buy a fcreign-made dictatorship gold brick. Here is a partial list of the cights that we all enjoy under the constitution. Who can read them and then say. honestly, that ne would rather take his chances under a dicta- tor by whom ai! such old-fashioned ideas have been discarded ia favor of a system in which no one can call his suul his own? The constitution guarantees to every citizen the following: the privilege of | habeas corpus, the trial of all charges | of crime by jury: freedom of religious worship: freedom of speech and of the press; the right of peaceable assembly and the right to petition the govern- ment for a redress of grievances; the right to keep and bear arms; the right to be secure in his person, his house. his papers and effects against unrea- |e searches and seizures. Search warrant, issued.on probable cause, supported by oath or affirmation, and describing the place to be searched, and the persons or things to be seized. Further, there shall te no trial for a capital offense except. on. present- ment or indictment by a grand jury. No one shall be twice put in jeopardy for the same offense; nor com- pelled in any criminal case to testify against himself; nor be deprived of life. liberty or property without due process of law: nor shail his property be taken for public use without just compensation. In every trial the accused shall be informed of the nature and cause of the accusation; he shall be confronted by the witnesses against him and shall bave compulsory process to obtain witnesses in his favor. Excessive bail shall not be required: nor excessive fines imposed, nc: cruel and unusual punishments inflicted. It is true that the machinery for making these rights effective does not always work absolutely perfectly, but this is certainly not a reason for dis- carding the guarantees. In war-time many of them are arbitrarily sus- pended. which is another good reasen fer avoiding this particular form of insanity. It is most significant that all of the agitators who are committed to a destruction of our government very much prefer to live in a democracy while singing the praises of auto- cracy. One leading member of this group was asked, at the close of a pub- would rather live here or under a certain foreign dictator. His reply was that as long as we have freedom of speech and trial by jury, he preferred to live here. Nothing could expose more com- pletely the insincerity of the under- ground work that is go:ng on to de- stroy the foundations of demoracy. It is impossible for the normal person to understand the kind of mental and moral disease that drives such persons te their nefarious activity. but we should realize that it is a kind of disease. It would be fatal to put our emphasis on repression rather than on immunizing the people through greater stress on the blessings of lib- erty under the ccnstitution.
