‘PAGE EIGHT FALSE METHODS * CHARGED IN PROPERTY SALES PETITION FILED AT JACKSON- VILLE CHARGING MISREP- RESENTATION BY DEVEL- _ OPMENT COMPANY (By Associated Preany JACKSONVILLE, June 22.— Federal Judge Rhydon M. Call,; today has under advisement the petition charging that misleading advertisements was used in news- papers, magazines and pamphlets by the Mizner Development ,Cor- poration, to wrongfully picture im- provements and existing condi- tions and to fool the public and prospective purchasers. The peti- tion was filed yesterday by Guy C. Reed, New York carpet manufac- turer, who asks that a receivership be appointed for the corporation, developers of Boca Raton, fashion- able resort, 26 miles south of West Palm Beach. Mr. Reed said the action was taken to protect his interests, and that promises of developments have been so elaborate as to be im- possible to fulfill due to the finan- cial status of the corporation. In his petition Mr. Reed also eharzed that directors of the cor- poration has paid in advance to officers of the corporation for ser- . vices not rendered, but supposed to be rendered at some future date, the sum of $260,000. Last November, four members of the board of directors, Coleman Dupont, Jesse L. Livemore, Holli- day S. Meeds and Louis H. Bean, all of New York, resigned. Gen- eral Dupont said the management was in the hands of executives not qualified to handle such a project and that the directors’ wishes were ignored. The petition charged that a pur- ported statement of the corpora- tion’s financial condition on March 31, 1926, gave the principal assets as notes payable for sale of prop- erty amounting to more than $21,- 000,000. Reed alleged all the notes amd contracts were consum- mated upon statements made in the advertising matter. The bill of particulars. also charged the corporation had out- sianding liabilities amounting to several million dollars due now or soon to become due, and has not sufficieat funds to meet them. He averred that unless a receivership ed is appointed creditors will be given 3 preference.
