Pursuant to adjournment the Board of County Commissioners of Itasca County, Minn., met at the Court House in the village of Grand Rapids, Minn., this 27th day of May, 1913, at 10 o'clock A. M. Members present; Commissioners Pas- sard, Nelson and O’Brien. In the absence of Ohairman Vice-Chairman Passard presided. Upon motion of Commissioner seconded by Commissioner minutes of the last meeting were aDP- proved by unanimous vote of all mem- bers present. Grand Rapids, M King, Velson, Commissioner O’Brien moved the adoption of the following resolution; Resolved that the petition and gen- eral plan and detailed estimate for the establishment, construction and im- provement of State Rural Highwat No. 5, in the County of Itasca, Minn., be and the same is heréby approved by the County Board of Itasca County, Minn. The motion was seconded by Com- missioner Nelson and said resolution was adopted by unanimous vote of all members present. Commissioner O’Brien moved that the Chairman appoint a committee of three to investigate and examine County Road No. 91, South of Swan River. The mo- tion was ‘seconded by Commissioner Nelson and carried by unanimous vote of {all members present. Committee appointed, Commissioners Nelson, O’Brien and Passard. Commissioner Shellman arrived at this time. It being the time set for hearing up- on the petition of J. F. O'Connell for a license to sell intoxicating liquors in the town of Wawina the same was then taken under consideration. There being no objectionns filed or offered against the granitng of said applica- tion, Commissioner O’Brien moved that said application be granted and a license issued to said J. F: O'Connell, further that the bond furnished in connection with said application, with Henry Hughes and D. M. Gunn as sure- ties, in the sum of $2000 be approved. The motion was seconded by Commis- sioner Nelson and upon roll call was carried by the folowing vote; Yea; Commissioners Nelson O'Brien, and Passard. Nay; Commissioner The bids for the construction of County Road No. 114 were opened and read, the bids being as, follows: J. A. It being the time set for the hearing upon the petition for the formation of a new. school distridt ‘in the town of Marcell, the same was then taken under consideration. Upon motion of Commissioner Shellman, sec- onded by Commissioner Nelson, the hearing upon said petition was con. tinued to the next meeting to be held on the 10th day of June, 1913, at! 10 o’clock A. M, by unanimous vote of all members present. t Commissioner Shellman. moved the adoption of the following resolution: Resolved that the sum of $50 be and the same is hereby appropriated from the County Revenue Fund to be ex- pended under the direction of Rev. O. Garrett, of Bovey, for ‘tle purpose of afding in tke appropriate obervance of Memorial Day on May 90th., 1913, pur- suant to. The motion was seconded by Commis- sioner O’Brien and garried’ by unani- mous vote of all members present. The bids for County Road’ No. 102 were then taken under consideration. Only one bid was received upon this road, the same being as follows: John O'Brien: Clearing six and one half acres at $75.00 per acre. Grading two thousand five hundred yards at $.76 per yard. Turnpiking ‘forty rods lineal rod. Ditching Eight hundréd at $.30 .per yard. Culverts .(Four) $15.00 each. Grubbing three hundred and lineal rods at $1.00 per rod. Corduroy forty two rods at $3.00 per rod. Drainage ditches forty cents per yard 3.40. (Not in specifications but neces- sary if work is done in wet time.) Commissioner Passard moved that said bid .be rejected. The motion’ was seconded by Commissioner Sheliman and carried by unanimous vote cf» all members present. Commissioner Shellman moved that the sum of $100 be appropriated frem the County Road and Bridge Fund to be expended under the direction of Com- missioner O’Brien in the improvement of the Vermillion Road. The motion was .seconded by Commissioner WNel- son and carried by unxnimous vote. The hearing upen tke petition for County Road No. 131 was continued to the next meeting. Commissioner O’Brien moved the ad- option of the following resolution: Resolved that the sum of $300 be and the same is hereby appropriated at $1.20 per cubic yards fifty from the County Road and Bridge Fund to the town of Marcell for the improvement of the road running North and South through ‘said town, parallel with the railroad right of way. The motion was seconded by Com- missioner Shellman and carried by un- animous vote of all members present. Commissioner Shellman moved that, Commissioner Passard be instructed to examine and ascertain the necessary repairs for County Road No. 47 at the Splithand Brook crossing, and to make report to the Board at its next meet ing. The motion was seconded by Commissioner Nelson and carried by unanimous vote of all members pres- ent. Commissioner Nelson moved that District Engineer Lidberg be. instruct- ed to survey and prepare plans and specifications for County Road No. .128, The motion was seconded by Com- missioner O’Brien and carried by un: mous vote of all members present. Commissioner O’Brien moved that’ Dis- trict Engineer Lidberg be instructed to survey and prepare plans and speci. { fications _ for County Road No. 130. The motion was seconded by Commis- Sioner Nelson and carried by’ unani. mous vote of ali members present. Commissioner Shellman moved that the County Auditor be instructed to ad+ vertise for bids for the contruction of {| County Road No. 107, according to the plans and specifications prepared by District Engineer Lidberg and filed in the office of the County Auditor. The motion was seconded by Commissioner O’Brien and carried by unanimous vote of all members. present. Commissioner Nelson moved that the sum of $500 be appropriated from the County Road and Bridge Fund to be expended under the direction of Com- missioner King upon the Grattan Road. The motion was seconded by .Comms- sioner O’Brien and carried by unani- mou vote of all members present, Commissioner Passard moved that the County Audtor be instructed to adver- tise for bids for the construction of a {| bridge across Splithand Brook, accord- ing to plans and specifications pre- pared by the State Engneer and filed in the office of the County Auditor. The motion was seconded by Commissioner O’Brien and carried by unanimous vote of all members, present. i The petition for the survey of See- tion 34, Township 56, Range 23, was continued to the mext meeting. The report of the Grand Jury of the March 1913 term of Court was read and upon motion was ordered filed. Upon motion of Commissioner Shell- man, seconded by Commissioner O’Brien, advertise for bids for the construction of a e escape leading from the jury room, on the third floor of the county court house. The Board then took under consider- ation the applications of the Great Northern Iron Ore properties for cor- rection of assessment and abatement of taxes. ‘Mhe following resolution was adopted: Whereas, the following applications for abatement of real estate taxes have’ been submitted to the Board of County Commissioners of Itasea County, name- ly, applications numbered 1 to 19 in. clusive, all of which involve the deter- mination of valuations on mineral lands, and Whereas, said board is in no posi- tion to determine the valuation of any said lands, and is of the opinion that all of said valuations should be de- termined by the Minnesota State Tax Commission, who have mineral experts to apsist them in arriving at valua- tions on mineral lands, ‘ Therefore, be it resolved that the matter of the approval or rejection of these applications be referred | to the Minnesota State Tax Commission. Commissioner Nelson moved that As- sistant State Engineer Lidberg be in. structed to go over the Wabana Lake Road and make report of the necessary repairs for said road. A petition was presented for the es- tablishment of highway beginning at the quarter post on the Section line be- tween Sections twenty two and twen. ty three (22 and 23), Township fifty eight, Range twenty four, West of the 4th p. m. in the center of the main tra- veled road running North and South at that point, running thence. East on the quarter line running East and West through Section 23 to the Hast line of said Section; running thence North .on the Section line between Sections 23 and 24 to the Northeast corner of Sec- tion 23; thence East along the Section line between sections 24 and 13 to the Town line between Towns 58, Range 24, and 58, Range 23; thence North along the said' Town line to the North line. of Town 58 and _ continuing thence North on the Town line between Towns 59, Range 24, and 59, Range 23 to a point where the Hartley Road cross- es and intersects said Town line, the whole road being approximately five and 3-4 miles in length. Commissioner Nelson moved that a hearing he had upon said petition at the, Court House in the Village of Grand Rapids on Monday, the lith day of July 1913, at 10 o'clock A. M., that Commissioners O’Brien, Nelson and Passard be a committee to examine the route of said proposed road, that said committee meet at the points of beginning of said route on Wednesday the 9th day of July 1913 at 11 o’elock A. M., for the purpose of examining said route, and that said committee make report to this Board at the time set for hearing upon said petition. The motion was seconded by Commissioner O'Brien and carried by unanimous vote. Commissioner Nelson moved that Court House and Jail committee be authorized and instructed to cause the necessary calcimining to be done in the Sheriff's residemce. The motion was seconded by Commissioner O’Brien and carried by unanimous vote of all mem- bers present. It being the time set for hearing up. on the petition for the establishment, construction and improvement of a State Rural Highway in said County, known and designated as State Rural Highway No. 4, the same was then ta ken under consideration. Gentlemen:— | In the matter of service of no- tices for State Rural Highway No. 4, I will state that I have examined the proofs of service of said notice, which are contained in three documents, viz. IN THE MATTER OF THE PETITION of B. C, Finnegan and others for a State Rural Highway in the County of Itasca, State of Minnesota: NX WHEREAS, A petition, bearing date the 25th day of April 1913, signed by B. C. Finnegan, W. C. Gilbert, B. A. sremer, D. M. Gunn, John Beckfelt, and F, A. King, praying for the estab. lishment, construction and improvement of a certain highway in said County, the route of which is more fully described in said petition, and a proper bond, having been filed with the County Auditor of Itasca County, Minn., as by law required. AND WHEREAS, It appears, by sat- isfactory proof to the County Board of said County that due notice of the pen- dency of said petition, and the time and place at which the same would be neard, has been given as required by law. : NOW THEREFORE, It is hereby or- dered that Roy K. Bliler be, and he hereby is, appointed as a competent and experienced engineer to make an ac- curate survey of the line of said rural aighway as provided by law,, and, after completing his duties as such engineer, to make ‘and file his report in the of- fice of the County Anditor of Itasca County on or before the 16th day of fune, 1913. Spang, County Auditor of said County, | shall thereupon first take an oath to faith- fully perform their duties as viewers; shall then receive from said County ‘Auditor’ a certified copy of the peti- tion for said highway, a certified copy or this order appointing them such view. ers, and a certified copy of said Order designating said time and place of their first meeting. @nd.—As soon as practicable thereafter they shall proceed, with or without said engineer appointed to make such sur- vey, am they shall deem best, to view and examine said proposed route of said highway and the work necessary to the *stablishment, construction and im- wrovement thereof, shall view and ex- amine the several tracts of land which, in their opinion, will be benefitted and ‘damaged by the establishment, con. struction and improvement of said pro- posed highway and in estimating sai@ benefits they shall consider and take inte account all lands which, in their opinion, will be benefitted in any man- ner whether they lie contiguous to said proposed highway or not, and whether said highway shall pass through or along the said lands or not; 3rd.—They shall ascertain and give, in tabular form and as a part of their report, the fotlowing information, facts and details: (A) the name or names of the owners of each tract of land which they shalt find may be benefitted and damaged by said proposed highway, whether the same be contiguous to said highway or not, said names to be the Same as appear on the county tax duplicates; (B) the descriptions in legal form of each tract which they shall find to be benefitted and damaged by said highway; (C) the total number of acres in each said tracts, the total number benefitted, and the total num- ber of acres damaged; (D) the amount which they shall estimate each of said tracts will be benefitted and the amount which they shall estimate it will be damaged; (E) the damages which they ehall estimate will result to any tract of land by reason of the construction and’ maintenance of any bridge, culvert, ditches, and any other construction or obstacle which they shall deem neces- sary and incident to the said highway; (G) the total benefits of said highway ag they shall estimate the same, and the total damages as they shall esti- mate the same. 4th.—They shall ascertain and report whether or not, in their opinion, the estimated expense of the construction of said highway will be greater than the utility and benefits thereof, and wheth- vr or not the construction of said on such matters concerning which they shall be unable to ‘agree; rv Rahomiinm fr Dated May 24th, 1918, James’ Passard, anc ag eg County Board, Ttasem County, .
