Gentlemen:- In the matter of the service of Notices for State Road Highway No, 4, will state that I have examined the proof of service of the notice, which are con- tained in three documents, as follows: First. The affidavit of publication made by E. C. Kiley; second, the affidavit of M. A. Spang, as to proof of mailing notices to non-resident land owners, within two miles of the proposed high- way; third, the affidavit of T. T. Riley, that he has posted notices in three of the most conspicuous places of each town, through which said highway runs. In the Matter of State Rural Highway No. 4. It having been made to satisfactorily appear that all preliminary conditions in the above entitled matter have been complied with, and G. W. Cooley, State Highway Engineer, as an experienced and competent engineer having been ap- pointed to make a survy of said pro- posed highway and report thereon: Now Therefore, John H. Carlson and A. H. Randahi and L. W. Huntley, who are resident freeholders of said county M. They shall meet, preparatory to the commencement of their duties, at a time and place to be hereafter desig- nated by the order of the Auditor of Itasea County, Minnesota, shall there- upon first take an oath to faithfully per- form their duties as viewers; shall then receive from said Auditor a certified copy of the petition for said highway, a certified copy of this order appointing them such viewers, and a certified copy of said order designating said time and Place of their first meeting. 2nd. As soon as practicable thereafter they shall proceed, with or without said engineer appointed to make said survey, as they shall deem best, to view and examine said proposed route of said highway and the work neces- sary to the establishment and construc- tion thereof, shall view and examine the Several tracts of land which, in their »pinion, will be benefited and damaged by the establishment and construction of said proposed highway, and in esti- | mating said benefits théy shall con- sider and take into account all lands which, in their opinion, will be benefit- ted in any manner whether they lie contiguous to said proposed highway or not, and whether said highway shall pass through or along the said lands or not. 3rd. They shall ascertain and give, in tabular form and as a part of their re- port, the following information, facts | and details: (A) The name or names of the owners of each tract of land which they shall find may be benefit- ted and damaged by said proposed highway, whether the same be con- | tiguous to said highway or not, said names to be the same as appear on the county tax duplicates; (B) the des- criptions in legal form of each tract which they shall find to be benefitted | and damaged by said highway; (C) the total number of acres in each of said tracts, the total number bénefitted and the total number of acres damaged; (D) the amount which they shall esti- mate each of said tracts will be bene- fitted and the amount which. they shall estimate it will be damaged; (E) the damages which they shall estimate will result to any tract of land by reason of the construction and maintenance of any bridge, culvert, ditches, and any other construction or obstacle which they} shall deem necessary and incident to said highway; (G) the total benefits of said highway as they shall estimate the same, and the total damages as they shall estimate the same. 4th. They shall ascertain and report whether or not, in their opinion, the estimated expense of the construction of said highway will be greater than the utility and benefits thereof, and whether or not the construction of said highway is practicable, and if impracticable, in | their opinion, the reasons why they consider it impracticable and why it should not be established and construct- ed. 5th. If they shall be unable to agree upon any of said matters, each shall | make -his separate report and findings on such matters concerning which they shall be unable to agree. 6th. They shall keep accurate ac- count of their time and necessary ex- penses in the performance of said duties and furnish an itemized statement there- of in their said report or as a part thereof. 7th. In case they shall find it neces- sary, in the performance of their said duties, to secure legal advise or opinion, \ they shall apply to the County Attorney of Itasea County, who is hereby direct- ed to furnish the same to Said viewers. 8th. They shall prepare and file their full report of all their doings and con- clusions in said matter in the office of the County Auditor of said County, not later than the 10th day of May, 1913.
