OFFICIAL PROCEEDINGS OF THE BOARD OF COUNTY COMMISSIONERS ITASCA COUNTY, MINN ! publicly read and considered and argu- Grand Rapids, Minn., Sept. 20, 1911 Pursuant to.adjournment.the.board of County Commissioners of Itasca Coun- ty, met at the the Court house in the Village of Grand Rapids, this 20th day of September, 1911. Members present: lins and Nelson. An adjournment was then taken to 3 o'clock p.{ m. Pursuant to adjournment the Board again met at 3 o'clock p. m. Members present: Commissioners Mul- lins, King, Nelson and O’Brien. Inspector of Mines P. L, Ramquist pre- sented his annual report which was or- dered filed. The County Auditor was instructed to advertise for bids for the construction of that part of County Road number 101 known as the Old Winnipeg Right of Way road, beginning at Deer River and extending in a northwesterly di- rection to the Russell School House, a distance of about 7 miles. The said road to be constructed ac. cording to plans and specifications pre- pared by John A. Brown, Assistant State Engineer and filed in the office of the County Auditor. Chairman Sword of the.Board.of.Super- visors of the Town of Lake Jessie was present and requested an appropriation te aid said Town in the repair and con- struction of roads and bridges. Commissioners O’Brien moved that the sum of $300 be appropriated from the County Road and Bridge Fund to the Town of Lake Jessie, $150 of said amount to be expended upon the state road south of Bowstring Bridge and the balance to be expended upon such oth- er roads as the Board of Supervisors may deem proper. The motion wsa seconded by Commis- sioner Nelson and carried by unanimous vote Commissioner King moved that a com- mittee of three be appointed to examine the work done by Melvin N. Rosholt up- on the County roads numbered 27 and Commissioners Mul- 15 The motion was seconded by Commis- sioner O’Brien and carried by unani mous vote. Commissioners King, O’- Brien and Mullins were appointed as such committee. Said committee to meet September 27th, 1911. S. Brandon of the Board of Supervis- ors of the Town of Deer River was pres- ent and requested an appropriation from the Road and Bridge fund to aid said Town in the construction of roads. No action was taken at this time. It being the time set for hearing upon the petition for the establishment of Road 108 known as the Shoal Le 1, the same was then taken un- der consideration. The committee appointed to examine the route of said road filed their report they recommended that the of the petitioners be granted. Billock made claim for damages son of the establishment of said road across his land in the sum of $250. ; nil Gravelle also claimed damages in the sum of $275. After hearing all parties interested for and against the granting of said petition and the establishment of said road, Commissioner O'Brien moved that the report of the.committee.be.approved,.that the prayer of the petitioners be granted, that said highway be ordered established according to the committee's report, that the advantages and benefits to each description of land over which said road runs be assessed equal to the damages sustained, that said highway be known and designated as County Road number 108 and that the proper final order be executed by the Chairman of this Board and the County Auditor. The motion was seconded by Commis- sioner Nelson and carried by unanimous vote. Commissioner King moved the adoption of the following resolution: anty in which prayer John by re Resolved that relief in the sum of $15 per month be allowed to Mrs, Thaddeous O'Reilly. Said relief to commence on the Ist day of October and to continue in force until further action is taken thereon by this Board and that the County Auditor be instructed to issue his warrant monthly in payment of such lief. The motion was seconded by Commissioner Nelson and carried by un- animous vote. A petition was presented for the es- tablishment of a highway beginning at the northeast corner of section 5, Town- ship 55, Range and running thence west on town line to the northwest cor- ner of said section 5, Commissioner O'- Brien moved that a hearing be had up- on said petition at the court house in the Village of Grand Rapids, on Wednes- day the 15th day of November, 1911, | at 10 o’clock a. m. That Commissioners Nelson, Mullins and O’Brien be a com- mittee to examine the route of said pro- posed road, that said committee meet at the point of beginning of said route on Wednesday the 8th day of November, 1911, at 10 o’clock a..m. for the purpose of examining said route and that said committee make report to this Board at the time set for hearing upon said peti- tion. The motion was seconded by Com- missioner Nelson and carried by unani- mous vote. The matter of the petition of Karl W. Heyman and Fred Johnson.to.detach.cer- tain agricultural lands from the village of Warba was then taken under con- sideration. Commissioner King moved the adoption of the following order. Order Detaching Certain Lands The Village of Warba. Whreas, a petition signed by Karl W. Heyman as the owner of lots 2, 3, 6, 7 and 8 of section 21, Township 54, Range 23, and Fred Johnson as the owner of From the Board of County Commissioners of this county at a session of said Board held on the 15th day of August, 1911, for, the action of said Board thereon, and Where, it was then ordered by - said Board that a hearing be had upon said Petition at a session of said Board to be held on the 20th day of September, 1911, at the County Court house in the Village of Grand Rapids, and Whereas due notice of the time and place of said hearing has been given as provided by law, and Whereas said petition has now been ments of all persons interested therein have been duly heard and considered, it is hereby ordered hat the said petition be granted and the following described lanidg to-wit: \Lots 2, 3, 6, 7 and 8 of section 21, and the northeast quarter of section 20, Township 54, Range 23, be and the same are hereby detached from the Village of Warba. The motion for the adoption of the foregoing order was seconded by Com- missioner Nelson and carried by unani- mous: vote. Commissioner O’Brien moved that the County Surveyor be instructed to make a survey of a county road beginning at the southwest corner of section 19, Township 54, Range 23, and running south on range line a distance of two miles to the southwest cor- ner of said Township, thence west on town line to the southwest corner of section 36, Township 54, Range 24. The motion was seconded by Commis. sioner King and carried by unanimous vote. The County Surveyor was instructed to make a survey of the County Road run- ning south of Marble into Township 55, Range 23, said road connecting with Town road known as the Seaburg Road. Commissioner Nelson moved that the sum of $250 be appropriated from the County Road and Bridge fund to be expended under the direction of Commis- sioners O’Brien and ‘Nelson in the improvement of the old Prairie Road in Township 59, Range 24. The motion was seconded by Commissioner King and carried by unanimous vote. Attorney R. A. Stone for and in be- half of the petitioners for a new School Distriét to be composed of the territory included in the organized Town of Mar- cell which said petition was heard at a meeting of the Board held on the 19th day of July, 1911, requested the Board to make an order granting the said pe- tition, describing the said new School district giving the number of the same, and further requesting the Board to give ten days’ posted notice for a meet- ing to organize the said new district. If the foregoing request is denied by the board then in behalf of.said.petition- ers he requests the Board to take some action on said petition either granting or rejecting the same. The matter was temporarily laid over and referred to the County Attorney for an opinion. Commissioner King moved that the Court House and Jail committee be au- thorized and directed to make all ne- cessary repairs upon the sheriff’s barn. The motion was seconded by Commis- sioner Nelson and carried by unanimous vote. Upon motion of Commissioner O’Brien, E. R. Browne was awarded the job of putting a new asbestos shingle roof up- on the Court house, same to be done in accordance with plans and specifica- tions prepared by D. V. Case.and.Broom- hall, Architects of Duluth for the sum of $500. Also for the furnishing of all ma- terial and labor for putting on gelvaniz- ed iron work on the roof of the court house, in accordnace with the plans and specifications, for the sum.of.$489.25, also for furnishing all material and labor necessary for replacing the decks on the Court House roof according to plans and specifications for the sum of $360.75. Commissioner O’Brien moved that D. V. Case and Broomhall, Architects be directed to prepare plans and specifica- tions for all necessary painting and for the repair of all plastering upon the court house, also for remodeling the jury box in the court room, and that the County Auditor be.instructed.to.advertise for bids for said work in accordance with said plans and specifications. The motion was seconded by Commis- sioner King and carried by unanimous vote. The hearing upon the application of Joseph Flower for license to sell intoxi- cating liquors at Snow Ball in } the Town of Greenway was then taken up. Commissioner O’Brien moved that said application be rejected. The motion was seconded by Commissioner Nelson and upon roll call the vote was as follows: Yea: Commissioners Nelson, O’Brien an Mullins. Nay: Commissioner King. It being the time set for hearing upon the application of George Brusewitz for a license to sell intoxicating liquors in the townsite of Stanley in the Town of Wirt, the same was then taken under consideration. Commissioner Nelson moved that said application be rejected. The motion was seconded by Commis- sioner O’Brien and upon roll call the yote was as follows: Yea: Commission- ers Mullins, O’Brien and Nelson. Nay: Commissioner King. Commissioner King moved that the As.| sistant State Engineer be instructed to go over the State Ditch north of Deer River and make an estimate for the re- pairing of the same. The motion was seconded by Commissioner O’Brien and carried by unanimous vote. Commissioner Nelson moved that the Chairman appoint a committee of three to examine the Feeley-Bovey road near Ole Hanson’s place. The motion was seconded by Commissioner O’Brien and carried by unanimous vote. Commis- sioners Nelson, O’Brien and Mullins were} appointed as such committee. Commissioner Nelson moved that a committee of three be appointed to ex- amine the work done under the Callahan contract upon County road number 42. | The motion was.seconded.by.Commission- er O’Brien and carried by unanimous vote. Commissioners King, Nelson and O’- the Northeast quarter of section 20, Township 54, Range 23, asking that an order be made detaching said lands from the Village of Warba was presented to Brien were appointed as such committee. Commissioner King moved that the sum of $150 be appropriated from the County Road and Bridge fund to the Town of Bass Lake to aid said Town in the construction of a road on the west eighth line of section 86, of said Town. The motion was seconded by Commis- sioner Nelson and carried by unanimous vote. i Commissioner King moved that the sum of $250 be appropriated from the County Road and Bridge fund ‘to be ex- pended under the direction of Commis. sioners Nelson and King in the improve- ment of roads in unorganized township 148, Range 27. The motion was second- ed by Commissioner Nelson and carried | by unanimous vote. A petition was presented for the form- ation of a new common school district to be composed of the territory included in the organized Town of Nore being all of congressional Township 150, Range 29. Commissioner King moved that: a hearing be had upon said petition at the court house in the Village of Grand Rapids on Saturday the 14th day of Oc- tober, 1911, at 10 o’clock a. m., that no- tice of such hearing be given by publi- cation for two consecutive weeks in the Grand Rapids Herald-Review, by posting copies thereof in three of the most pub- lic place in each school district af- fected, and by mailing copies thereof to the clerk of each school district af- fected, at least ten days before the time set for hearing upon said petition. The motion was seconded by Commis- sioner O’Brien and carried by unanimous vote. Upon motion of Commissioner King seconded by Commissioner O’Brien the Plat of Trout Lake Park was approved. The following report of F. F. Price, Special Attorney was presented, read and ordered published. Grand Rapids, Minn., Sept. 20, 1911. To the Honorable Board of Itasca Coun- ty, Minnesota. Gentlemen:—In accordance with the resolution passed by your Honorable Body, at your regular meeting held on the 15th day of August last, resolution your approved of a settlement submitted by me (as your Special Attor-| ney) to your Honorable Body, namely, that upon payment by the National Sur- ety Company to the County of Itasca, of the sum of fifteen thousand dollars ($15,000.00) and the payment over by the Receiver of all moneys in his hands and the further turning over by the Receiver to your Honorable Body of all securities then held by him, that you would accept same in full settle- ment, I have to say that in accordance with such resolution I prepared a peti- tion to the Honorable District Court, asking said Court to approve of said set- tlement, and I also prepared a petition of the Receiver, Mr. Charles E. Aiken, asking said court to pass his account, fix his compensation and permit him to turn over the securities to the Coun- ty of Itasca. On the 29th day of August last the matter came before the Dis. trict Court at the City of Bemidji, Min- nesota, and on said day the Court ap- proved of the settlement which was re- commended by your Honorable Body, aré thereupon made an order directing Receiver to turn over the money and property then in his hands and the se: curities to the County Treasurer. The court first fixed the compensation of the Receiver at the sum of five hun- dred dollars ($500.00), and in thus fixing the compensation of the said Receiver the Court took into consideration the fact that the Receiver had saved the County of Itasca the sum and amount of about four hundred dollars ($400.00) and better, by giving a personal bond instead of a surety bond, in addition to the sum of five hundred dollars ($500) there was the sum of one hundred eigh- ty-seven and 6-100 dollars ($187.06) dis. bursements which had been incurred by the Receiver in connection with the ob- taining assignment of the securities and the ‘administration of his duties which said allowance made a total of six hun. dred eighty-seven and 6-100 dollars ($687.06), which the said Court allowed and fixed as the compensation for such Receiver, and thereupon the Court directed the Receiver to turn over to the County Treasurer the balance then remaining in his hands, namely, eleven thousand two hundred twenty-one and 5-100 ($11,221.05) together with all the securities then remaining in the hands of the said Receiver, with the exception of a certain mortgage for twelve hun- dred dollars ($1,200.00) (which is known } as the Billedeau Mortgage), which is one Birdie M. Kremer In accordance with such order I caus- ed the same to be filed and entered in District dollars | ($15,000.00) in cash ,which said sum was turned over and paid to your County Treasurer, as follows: 1911, September 10th. Treasurer securities in the shape of reat- estate, amounting to the further sum of thirteen thousand seven hundred fifty dollars ($13,750.00), and also unsecured notes up” on which there is due the sum of one hundred sixty dollars ($160.00) or there- abouts. In addition thereto I have turned over to the County Treasurer certain stocks consisting of corporation stocks and stocks in local Banks, estimated at the sum of five thousand one hundred fifty dollars ($5,150.00) and Deeds to Real Estate, which have been conveyed to the County of Itasca estimated at the sum of two hundred fifty dollars ($250) all of which said securities are contain- ed in the list which is hereto annexed and which, according to said list amount to the sum of nineteen thousand three hundred tén dollars ($19,310.00) which with the payment in cash already made in which | the | mortgages, | receipt by the County of Itasca of the {sum of forty-five ‘thousand nine hundred eighty-one and 77-100 dollars ($45,981.77), in addition to this there is accrued in. terest due upon several of the loans fall- ing due in the months of November, De- cember, May and June next, which will of course increase the payment to your County. I have prepared the necessary papers for the several Bonding Companies and same have been executed by the proper officers in accordance with the direc- tions contained in the resolution passed by your Honorable Body as before men- tioned, and nothing further remains to be done to close the matter up with | the Bonding Companies. I desire at this time to say that an action has been brought against the Receiver at the instance of Birdie M. E. Kremer, claiming the mortgage men- tioned and described as one of the se. curities, and known as the Billedeau Mortgage, and which amounts to the sum of twelve hundred dollars ($1,200) and interest and the action will be tried at the next Term of District Court, which convenes here in October next. I believe that the County of Itasca \and the Receiver have a fair chance of succeeding in the action, and the ac- tion is being fought with a view of sav- ing this additional security for the County. I desire to draw the attention of your Honorable Body to the fact that . the interest due upon the Ponti Mortgage is in arrear since the month of Novem- ber, 1909, and that in the month of No- vember, 1910, there accrued due the sum and amount of two hundred eighty dollars ($280.00) for interest, and that | there will be due in November 1911 the additional sum of two hundred eighty dollars ($280.00), making a total interest of five hundred sixty dollars ($560.00). I have used every endeavor in my power | to make collection of this interest, but | without avail, and I therefore draw the, matter to the attention.of.your.Honorable | Body to take whatever action in the | premises as may seem fit to order tak- | en.
