PROCEEDINGS BOARD OF COUNTY COMMISSIONERS ITASCA COUNTY, MINN Grand Rapids, Minn., Aug. 15, 1911 Pursuant to adjournment the Board of County Commissioners of Itasca County, Minnesota, met at the Court House in the Village of Grand Rapids, Vhis 15th day of August, 1911, at 10 o’clock a. m. Members present: Commissioners Mul- lins, O’Brien and Nelson. Upon motion the minutes of the meet- Ings of July 10th, 11th, and 19th were approved. A request was made for the renewal for a period of two years of the mort. gage loan made to Catherine Hoolihan under the Provision of Chapter 202 of the General Laws of 1905, on the 22nd day of September, 1909, which said loan becomes due and payable on the 25th day of September 1911. Commissioner O’ Brien moved that a renewal be granted and that said loan be extended for a period of two years from the 25th day of September, 1911, upon the execution and delivery of a new note and mort- gage and furnishing of a complete ab- Stract of title to date, on the lands covered by said mortgage, all to be approved by the County Attorney. The plat of the Survey of section 19, Township 56, Range 26, was presented to the Board for approval. Commissioner O'Brien moved that said plat be ap- proved and the Chairman instructed to certify the same. The motion was sec- conded by Commissioner Nelson and carried by unanimous vote. Upon motion of Commissioner O’Brien seconded by Commissioner Nelson the assessment for the cost of the survey of section 24, Township 55. Range 25. and section 31, Township 56, Range %5, was confirmed. It being the time set for hearing upon the petition for the survey of section 5, Township 55, Range 26, the same was taken under consideration. There being no objection filed or offered against the granting of said petition Commissioner O’Brien moved that said petition be gramted and that John A. Brown, Coun- ty Surveyor of Itasca County, be ap- pointed to make a survey of said sec- tion, the said survey to commence on the 15th day of September, 1911, The motion was seconded by Commissioner Nelson and carried by unanimous vote. It being the time set for hearing upon tthe petition for the survey of sections 7 and 8, Township 150, Range -28, the same was taken under consideration. A communication from A. C. Anderson. one of the petitioners requesting that his name be withdrawn from said peti- tion and objecting to said proceedings was read by the County Auditor. Upon motion of Commissioner Nelson seconded by Commissioner O’Brien said petition was laid over to the next meeting for further consideration. Upon motion all the members of the Board were appointed a committee to examine the bridge across the Swan Riv- er at Willman’s place on the Feeley-Bo- vey road, which bridge was recently completed by Contractor H. J. Cooper. Commissioner O’Brien moved the adop- tion<of the following resoluticn: Resolv- ea that the sum of $200 be and fhe same is hereby appropriated from the County Road and Bridge fund to be ex- pended under the direction of Frank Voigt in the improvement of the Deer ‘Lake Road. The motion was seconded ‘by Commissioner Nelson and carried by unanimous vote. Commissioner Nelson moved that the chairman appoint a committee of three to let the job for the improvement of the old Trout Lake road near Martin’s place in Township 58, Range 25. The amount to be expended not to exceed $250. The motion was seconded by Commissioner O’Brien and carried by unanimous vote. The chairman then appointed Commis- sjoners Nelson, O’Brien and Mullins as oe B95. + $30.00 50.50 A communication from the County Au. ditor of Cass County together with a copy of a letter from the State Highway Commission to’the County Attorney of Cass County in regard to funds for the construction of a bridge across the Mississippi river between the counties of Cass and Itasca was presented and read by the County Auditor. An adjournment was then taken to 1:30 o'clock p. m. Pursuant to adjournment the again met at 1:30 o’clock p. m. Members present: Commissioners Mul- lins, O’Brien, Nelson and Shellman. The following bids for road construc- tion were then opened and read: For County Road No. 99. A. A. Mitchell and Henry Volke for $2.75 per rod and $12 each for culverts. Ramquist & Murphy for the sum of $1,650. C. S. Brock for the sum of $1,740. For County Road No. 90. Wm. Smith for $2.25 per rod. H. F. Schutt for the sum of $1,580. Melvin M. Rosholt for the sum of $2.45 ‘per rod. M. W. Pogue for the sum of $2,000. For the construction of a highway be- ginning at the south quarter post of section 24, Township 62, Range 26 and running thence east on section line to the Bigfork River. Wm. Smith for the sum of $2.35 per rod, and 22 cents per cubic yard for any hecessary drainage ditches. Commissioner Nelson moved that the bid of Mitchell and Volke for the con- struction of road No. 99, be accepted. The same being the lowest and best bid. The motion was seconded by Com- missioner Shellman and carried by un- animous; vote. Commissioner O’Brien moved that the bid of Wm. Smith for the construction @ road beginning at the south quarter Post of sdction 24, Township 62, Range | 26, and running thence east on section line to the Bigfork River, be accepted. The motion was seconded by Commis- sioner Nelson and upon roll call was carried, the vote being as follows: Yea: Commissioners Mullins, O’Brien and Nelson. Nay: Commissioner Shell. man, who expjained in voting no that he did so upon the ground that there was only one bid presented and that said bid was indefinite. Commissioner O’Brien moved that the did of H. F. Schutt for the construction of road No. 90 be accepted the same being the lowest and best bid receiv- ed fer said road. The motion was sec- onded by Commissioner Shellman and carried by unanimous vote. Commissioner O’Brien moved that the sum of $150 be apropriated from the County Road and Bridge fund to be ex- pended under the direction of Commis- sioner Shellman in the improvement of County Road No. 63. The motion was sec- onded by Commissioner Shellman and carried’ by unanimous vote. A petition was presented for the es- tablishment of a highway beginning at the southeast corner of the NE% of NE of Section 32, Township 56, Range 25, and running thence west on the north one-eighth line of said section 32, and section 31 of said Township and continuing west on the north one-eighth line of section 36, Township 56, Range 26, to the southwest corner of lot one, section 36, Township 56, Range 26. Commissioner O’Brien moved the adop: tion of the following order: State of Minnesota, County of Itasca, ss. Whereas, on the 15th day of August, 1911, a petition signed by twenty-four freeholders of said County was present- ed to us praying for the establishment of a highway running into more’ than ‘one town of said County, and not with- in the limits of any incorporated city, and described as follows: Beginning at the southeast corner of the NE¥ of NE\ of section 32, Township 56, Range 25, running thence west’ on the north one-eighth line across said section 32 and section 31 of said Town- ship and continuing west on the north one-eighth line of section 36, Township 56, Range 26, to the southwest corner of Lot 1, Section 36, Township 56, Range! 26, and to be connected with other roads as follows: Road known as Prairie River road at point of beginning and County Road No. 73, at the southwest corner of lot 2, sec. ‘tion 31, Township 56, Range 25, and ter- minating at the southwest corner of lot 1, section 36, Township 56, Range 26, ang to be 4 rods in width. And the Board of County Commissioners of said County having determined that in the judgment of a majority of its members said petition is reasonable on its face. It Is Hereby Ordered, That a hearing be had on said petition at the County court house in the Village of Grand Rap- dds in said County on Wednesday the 20th day of September, 1911, at ten o’clock a. m. at which time and place said Board will hear all that may be said in favor of and against the granting of said petition. It Is Further Ordered, That Commis- sioners Mullins, Nelson and O’Brien, members of this board be, and they here- by are, appointed a committee to ex- amine said proposed route of said road and that said committee meet upon the route of said road at the point of be- ginning of said route in said County, on Saturday, the 16th day of September, 1911, at 10 o’clock a. m. for the purpose of examination of said proposed route of said road, and make report thereof at said meeting of said Board hereinbe- fore specified, and that notices hereof be given and posted as provided by law. In consideration of the facts as above set forth and pursuant to the provisions fully ask that theBoard of County Com- appropriate the other one-halr of the cost of the construction of said bridge, and that said County Board shall forthwith, as provided by said Chapter 423, Laws of 1907, designate two of its members as @ committee to cooperate with the supervisors of said Township of. Commissioner Nelson moved that the said petition be allowed and that one- half of the amount stated in said peti. tion to-wit: $800, be appropriated from the County Road and Bridge fund for the purpose of paying one-half of the cost of said bridge, and that Commis- sioners O’Brien and Nelson be appointed a_committee to act with the Town Board of the Town of Balsam in letting of the contrate for said bridge. The motion was seconded by Commissioner Shellman and carried by unanimous vote. A petition signed by Karl W. Heyman ‘and Fred Johnson for separation of cer- tain unplatted agricultural lands from the Village of Warba was then consider- ed. Commissioner Shellman moved the adoption of the following resolution: Whereas on the 14th day of August, 1911, a petition was filed in the office of the County Auditor of Itasca County, Minnesota, signed by Karl! W. Heyman @s owner of lots 2, 3, 6, 7, and 8 of section 21, Township 54, Range 23, and Fred Johnson as owner of the NE of section 20, Township 54, Range 23, pray- ing that an order be made by _ the Board of County Commissioners of Itas. ca County, Minnesota, detaching said lands from the Village of Warba. The reason stated in said petition being that said lands are unplatted lands, used solely for agricultural purposes and that the same are not so conditioned as to be properly subjected to village govern- ment and are not necessary for the reasonable exercise of the police pow- ers or other functions of said village. Therefore be it resolved that said pe- tition be heard at a meeting of this Board to be held at. the County Court House in the Village of Grand Rapids in said County on Wednesday the 20th day of September, 1911, at 1¢ o’clock a. m. at which time and place this Board will hear all persons interested for and against the granting of said petition and the County Auditor cause the proper notice of hearing to be posted and signed as provided by law. The motion was seconded by Commis- sioner O’Brien and carried by unani- mous vote. It being the time set for hearing upon the application of Joseph Flowers for license to sell intoxicating liquors at Show Ball the same was then taken under consideration. Commissioner O’- Brien moved that said application be rejected. There was no second to the motion. Commissioner Nelson moved the adop- tion of the following resolution: Re. solved that the sum of $300 be and the same is hereby appropriated from the County Road and Bridge fund to the Town of Popple to aid said Town in the repair of roads and bridges. The motion was seconded by Commissioner Shell- ‘man and carried by unanimous vote. A communication from the Chairman of the Town Board of the Town of Car- penter asking that a state public exam- iner be requested to make an examina- tion of the books and accounts of said Town, was read and laid over to the next meeting. Commissioner Nelson moved that the suim of $75 be appropriated from the County Road and Bridge fund to be ex- pended under his direction in the im- provement of the Lawrence Lake road. The motion was seconded by Commis- sioner Shellman and carried by unani. fous vote. It being the time set for hearing upon the petition for the establishment of a County Road No. 102, the committee ap- said oad filed their report in which they recommend that the prayer of the pe- titioners be granted. Commissioner O’- Brien moved the adoption of the follow- ing order: State of Minnesota, County of Itasca, 83. At a meeting of the board of County Commissioners of said County, held August 15th, 1911, a copy of the report of the committee appointed by us ai our jast session to examine the road here. inafter named, having been duly return- ed, by which said report it appears that the said committee met at the time and place designated in our order of ap- pointment and examined the highway proposed to be established, viz: beginn- ing at one-eighth stake, eighty rods east. of northeast corner of section four, Township number fifty-six, Range twen- ty-four on north line of said Township and running thence west on said Town Nine for a distance of one and one-half miles, to one-eighth stake, eighty rods West of the northwest corner of section four, Township fifty-six, Range twenty- four. And recommended that the prayer of the petitioners for the establishment of said highway be granted; and a major- ity of the Board of County Commission- ers being of the opinion that the pub- lic interest would be promoted by the establishment of said highway and that the establishment of said road would be of sufficient advantage to the County to warrant the paying of the damages hereinafter assessed, we do hereby order and determine that the prayer of said petitioners be granted, and that a highway be and is hereby established according to the description above given, which is hereby declared to be a highway to be known and des- ignated as County Road No. 103 and the Auditor is hereby directed to notify ‘the Supervisors of the several towns through which such highway is establist-.| ed, that they cause so much of said highway as lies in their respective towns to be opened without delay. At a meeting of the board of County Commissioners of said County, held August 15th, 1911, a copy of the report of the committee appointed by us at our last session to examine the road here- inafter named, having been duly re- turned, by which said report it appears that the said committee met at the time and place designated in our order of appointment and examined the high- way proposed to be established, viz: Beginning at the quarter post between sections 22 and 27, Township 55, Range 27 and running thence east on section line one mile to quarter post between sections 23 and 26 of said Township. And recommended that the prayer of the petitioners for the establishment of said highway be granted; and a major- ity of the Board of County Commission- ers being of the opinion that the public County of Itasca, lishment of said highway and that the establishment of said road would be of suffictent advantage to the County to warrant the paying of the damages here. inafter assessed, we do hereby order and determine that the prayer of said Petitioners be granted and that a high- way be and is hereby established ac- cording to the description above given, which is hereby declared to be a public highway to be known and designated as County Road No. 104, and the Audito is hereby directed to notify the Super- visors of the several towns through which such highway is established, that they cause so much of said high- way as lies in their respective towns 0 be opened without delay. We have assessed the damages sus- tained by reason of the establishment of said road to the lands over which the same passes and to the owners thereof, as follows; The advantages and benefits to each interest would be promoted by the estab, ee description of land over which said toad passes are hereby assessed equal to the damages sustained. Upon motion the hearing upon the pe- titions for the establishment of County Roads Ncw. 80, 105, 106, and 107 was continued to the next meeting to be held on the 20th day of September, 1911. Commissioner Nelson moved that a committee be appointed to sell the job for the construction of three-fourths of a mile of road beginning at the north- east corner of section 6, Township 54, Range 23, running west on Town line. The amount not to exceed $300. The motion was seconded by Commissioner O’Brien and carried by unanimous vote. Commissioners Mullins, O’Brien and Nelson were appointed as such commit- tee. Kremer, Ex-County Treasurer, came before the Board and presented an offer of settlement which he had received from the National Surety Company, through their attorneys, and after care- ful consideration of the proposition the following resolution was introduced by Commissioner O'Brien. The following Resolution was duced by Commissioner O’Brien. Whereas, Arthur A. Kremer was at the General Election held in the month of November, 1904, duly elected County Treasurer of the County of Itasca, and State of Minnesota, and on the 27th day tf December, 1904, duly entered into a Bond with Arthur A. Kremer, as princi- pal, and National Surety Co., of New York, as Surety, to the State of Minne- sota, in the sum of seventy-five thou. Sand dollars ($75,000.00), which Bond was conditioned for the faithful execu- tion of the duties of the office of Coun- ty Treasurer of said County and the safe keeping and paying over of all moneys coming into his hands for State, County, Township, School, Road, Bridge, Poor, Town and all other Purposes, which Bond was thereafter duly approv- ed by the Board of County Commission- els of said Itasca County as provided by law, and was duly filed in the office of the Register of Deeds of said Coun- ty, as provided by law, and was duly ffled with the proper State Officer, and on the first Monday in January, A. D. 1905 the said Arthur A. Kremer duly en- tered upon the discharge of his duties and continued to discharge the said duties of office as County Treasurer until the first Monday in January, 1907. And, Whereas, the said Arthur A. Kremer at the General Election held in the month of November, 1906, was du- ly elected to the office of County Treas. urer of said County, and thereafter and on the 26th day of November, A. D. 1906 duly gave Bond to the State of Minnesota in the sum of seventy-five thousand dollars ($75,000.00) with Ar- thur A. Kremer as principal and The Metropolitan Surety Company, of New Work, as surety, for the faithful exe- cution of the duties of said County Treas- urer of said Itasca County from the first Monday of January, 1907, and until the first Monday of January, A. D. intro- 1909, which said Bond was conditioned that he should safely keep and pay over according to law all money which may come into his hands for State, County, Township, School, Road, Bridge, Poor, Town and all other purposes, which said Bond was duly approved as required by law by the Board of County Commis- sioners of said County, and was duly re- corded in the office of the Register of Deeds of said Itasca County, as is provided by law, and which said Bond was duly filed in the office of the prop- er State Officers, as required by law, and which said Bond remained in full forée and effect during the continuance of the term of said Arthur A.
