COUNTY COMMISSIONERS TASCA COUNTY, MINN Grand Rapids, Minn., April 4, 1911. Pursuant to adjournment the Board of County Commissioners of Itasca Coun- ty, Minnesota, met at the County Court House in the Village of Grand Rapids, this 4th) day of April, 1911. Members present: Commissioners Mul lins, King, Nelson and O’Brien. Upon motion of Commissioner King the County Surveyor was instructed to survey County Road number 92, in Town ship 56, Range 27, also County Road number 79 in Townships 55, Range 24, 54-22, and 55.23. A petition was presented for the in- corporation of certain territory as the Village of Warba. Wm. F. McCaffrey owner of certain Jands proposed to be included in said incorporation, was present and objected to having said lands included in said in- corporation. Karl Heyman also owner of certain lands proposed to be included in said incorporation filed written objection upon the ground that said lands are held as ‘a homestead, upon which final Proof has not been made, which was read by the County Auditor. The matter was temporarily laid over and referred to the County Attorney. The plat of Alder was presented to the Board for approval. Commissioner King moved that said plat be approved by the Board upon the condition that an abstract of title to the land platted be furnished by the owner thereof, said abstract to be ap- Proved by the County Attorney. The motion was seconded by Com- missioner O’Brien and carried by unani- mous vote. Commissioner King moved that the matter of the petition of Frank Payne for liquor license, at Ball Club, be re- considered. The motion was seconded by Commis- sioner Nelson and upon roll call was carried by the following vote. Yea:Com- missioners King, O’Brien and Nelson. Nay: Commissioner Mullins. Commissioner Shellman was not pres- ent. Commissioner King then moved that said application be granted and license ordered issued. The motion was seconded by Commis- sioner Nelson and upon roll call was carried by the following vote: Yea: Commissioners King, and Nelson. Nay: Commissioner Mullins. The petition of Emil Erickson for a liquor license in the Town! of Marcell was then taken under consideration. There being no objection flied or offer- ed against the granting of said petition Commissioner «ing moved that said petition be granted and license ordered issued to said Emil Erickson. The motion was seconded by Commis- sioner O’Brien and upon roll call was carried by the following vote: Yea: Commissioners King, and Nelson. O'Brien O'Brien be opened and considered at a meeting of the Board to be held on the 4th day of May, 1911. The motion was seconded by Commis- sioner O’Brien and carried by unanimous vote.» It being the time set for hearing up- on the petition for the establishment of County Road number 80, the same was then taken under consideration. The com! mittee appointed to examine the route o said road reported that they desired to make a further examination’ of said route and upon motion the hearing up- on said road was.continued.until next meeting, to be held on the 4th day of May,1911, at 10 o’clock a. m. The com- mittee to meet at the point of termina- tion of said road, being the northeast corner of the NE% of SW\% of Section 12, Township 149, Range 28, on Tuesday the 25th day of April, 1911, at one o’- clock p. m. Said motion was duly seconded and carried by unanimous vote. A petition was presented for.the repair- ing and cutting down of hills upon a portion of the Feeley-Bovey Road, com- mencing at the quarter post on the north side of section 4, Township 55, Range 24, and running south to the point where said road intersects the Grand Rapids-Trout Lake Road. After some discussion of the matter, Commis- sioner King moved that the chairman appoint a committee of three to exam- ine said road and make report of said examination to the Board at its next regular meeting to be held May 4th, 1911, The motion was seconded by Com- missioner Nelson and carried by unani- mous vote. A petition was presented for the es- tablishment of a highway beginning at the quarter post between sections 31 and 32, Township 56, Range 23, and running thence east on quarter line to the quarter post between sections 32 and 383 of said Township, thence south on section line to the Town line between Townships 55 and 56, Range 23, thence east on said Town line to the quarter post on the south side of section 33, Township 56, Range 23. Commissioner «.1ing moved that a hear ing be had upon said -petition at the Court House in the Village of Grand Rapids on Thursday the 8th day of June, 1911, at 10 o’clock a. m., that Commissioner Shellman, O’Brien and Mullins be a committee to examine the route of said proposed road, that said committee meet at the point of begin- ning of said route on Thursday the Ist day of June, 1911, at 11 o'clock a. m., for the purpose ofexamining said route and that said committee make report to this Board at the time set for haar. ing upon said petition. The motion was seconded by Commis- sioner Shellman and carried by unani- mous vote. A petition was presented requesting the Board to complete a certain road oeginning at the railroad crossing be- tween sections 22 and 27 in Township 62, Range 26, and running east to the corner of sections 21 and 28 in Town- ship 62, Range 25. Commissioner King moved that the whole Board be appointed a committee to make an examination of said road. The motion was seconded by Commis- sioner O’Brien and carried by unanimous vote. An offer in writing was presented by P. C. Warner, civil engineer, in which he agreed to furnish six Jewett County maps, with all county and town roads so far as he is able to find a record therecf marked thereon, for the sum of, $40.00. Commissioner Shellman moved that said proposition be accepted and that Su... Percy C. Warner be authorized to Nay: Commissioner Mullins. Commissioner Shellman was not pres- ent. Bids for the construction of County Road number 75 on the Town line be- tween the towns of Sago and Feeley were then opened and read. The following bids were received: Melvin N. Rosholt for the sum of $995. David L. Ham for the sum of $1.78 per running: rod. H. S. Schutt for the sum of $1,250. The bid of Melvin N. Rosholt being the lowest and best bid, Commissioner King moved that said bid be accepted and the Chairman of the Board and the County Auditor be instructed to enter into a written contract with said Melvin N. Rosholt for the construction of said road. The motion was seconded by Commis- sioner Nelson and carried by unanimous vote. An adjournment was then taken un- tit one o'clock p. m. Pursuant to adjournment the Board again met at one o'clock p. m. Members Present: Commissioners King, Nelson and Shellman. The bids for the construction of a retaining wall at the rear of the County Courthouse_were then opened and read The bids ‘were as follows: Cc. R. McLean, $7,788.00. Commissioners Mullins and O’Brien ar rived at this time and the Board pro- ceeded to consider the bids. The bid of C. R. McLean being the lowest and best bid, Commissioner O’- Brien moved that said bid be accepted and that the Chairman of the Board ‘and the County Auditor be instructed to enter into a written contract with sai Cc. R. McLean for the construction of said retaining wall in accordance with his bid and offer and the plans and spe- cineations prepared by Architects D. V. Gase and Broomhall. The motion was seconded by Commis- sioner Nelson and upon roll call was carried by the following vote: Yea: Commissioners Mullins, O’Brien Shellman and Nelson. Nay: Commissioner King. Commissioner Nelson moved that the County Auditor be instructed to adver- tise for bids for the construction of a bridge across Swan River at Willman’s Place on the Feeley-Bovey Road. Said bids to be in accordance with plans and specifications prepared by Arch,t Case, and on file in the office of the County Auditor. Bids to be received for both steel and wood span bridges. Bids to Co., $8,- furnish such maps in accordance with his offer. The motion was seconded by Commis- sioner Nelson and carried by unanimous voe. E. J. Farrell was present and request- ed the Board to take action at as early a date as possiblein the opening of the road established on the range line be- tween the Townships of Grand Rapids and Bass Brook. Commissioner King moved that the chairman appoint a committee of three to examine said road. The motion was duly seconded and carried, commissioners King, Mullins and O’Brien being appointed as such committee. A petition was presented for the es. tablishment of a highway beginning at a point in the SW% of NW%, Section 34, Township 55, Range 27, and running thence in a southwesterly direction to the east and west quarter line, thence west on the quarter line to the third guide Meridian or county line to the quarter post on the west side of sec- tion 33, thence north on range line to intersect with the Cass County Road. Commissioner King moved that a hearing be had on said petition in the Court House in the Village of Grand Rapids on Thursday the 8th day of June 1911, at 10 o’clock a. m., that Commis- sioners Morris, O’Brien, Andy Nelson and C. M. King be a committee to ex- amine the route of said proposed road, chat said committee meet at the point of beginning of said route on Wednes- day the 31st day of May, 1911, at 11 o'clock a. m. for the purpose of exjam- ining said route and that said committee make report to this Board at the time set for hearing upon said petition. The motion was seconded by Com- missioner O'Brien and carried by unani- mous vote. Mr. Charles Gravelle came before the Board and made a proposition to take charge of the County Exhibit at the next state fair. He offered to take said Exhibit to the State fair for the amount he can secure in premiums up- on such Exhibit, the County to advance the amount of entry fee of $50 which amount would be refunded to the county after the fair. Commissioner King moved that the proposition of Mr. Charles Gravelle as herein stated be accepted. The motion was seconded by Commis- sioner O’Brien and carried by unani- mous vote. It being the time set for hearing up- on the petition for the survey of Section 31, Township 56, Range 25, the same was taken under consideration. Commissioner King moved that said Petition be granted, that John A. Brown,| County Surveyor of Itasca County, Min. nesota, be appointed to make the sur- vey and that said survey shall begin on the 27th day of April, 1911. The motion was seconded by Com- missioner Nelson and carried by unani- mous vote. It being the time set for hearing up- on the petition for the survey of Sec- tion 24, Township 55, Range 25, the same was taken under consideration. Commissioner King moved that said petition be granted and that John A. Brown, County Surveyor of Itasca Coun- ty, be appointed to make the survey and that said survey shall begin on Wed nesday the 3rd day of May, 1911. The motion was seconded by Com- missioner Nelson and carried by unani- mous vote. Upon motion the hearing upon the petition for the establishment of Coua. ' ty Road number 94 was continued to the next meeting. Commissioners King and Nelson who | were appointed a committee to examine and ascertain the necessity of a bridge across Bigfork River in Township 148, Range 27, reported that in their opinion a bridge should be constructed at that point and that same should be construct ed at the earliest time possible. The County Auditor was instructed to advertise for bids for the construction of a wooden bridge across the Bigfork River at point where county road num- ber 57 crosses the Bigfork River, in the NW% of Section 7, Township 148, Range 26, said bridge to be construct- ed according to plans and specifications to be prepared by D. V. Case and filed | in the office of the County Auditor. Commissioners Nelson and O’Brien re- ported that the planking in the floor of the draw bridge over the Mississippi River in Seeslon 22, Township 55, Range 27, was in very bad condition and that it was necessary that the same be re- paired at once. Upon motion the matter of re-plank- ing said bridge was referred to Com- missioner O’Brien, who was authorized to direct the necessary repairs. William Hoolihan and A. M. Sisler rep resenting the Itasca County Agricultur- al Association came before the Board and requested an appropriation for the County Fair to be held in the Fall of 1911. Commissioner King moved that the sum of $500 be appropriated from the County revenue Fund to the Itasca County Ag- icultural Association for the County Fair to be held in the Fall of 1911. The motion was seconded by Com- missioner Shellman and carried by unani mous vote. The matter of the petition for the incorporating of the Village of Warba was again taken up. County Attorney McOuat advised the Board that in his opinion the rignts of a homesteader whose claim is within the limits of the territory which is about to be incorpor- ated will not be affected by incorpora- tion as a Village if the entry is made prior to the taking of any steps toward such incorporation. Commissioner © orien moved the a- doption of the following resolution. Whereas, there has been to us pre- sented a petition for the incorporation of a village to be known as the “‘Vil- lage of Warba,” setting forth all the facts required by law to be therein stated, and signed by more than twen- ty-five of the voters residing within ne territory proposed to be incorpor. ated as a village and accompanied by an accurate census of the resident; pop- ulation of said territory verified by the oaths of three of said petitioners as re- quired by law; Now, therefore, be-it resolved by the Board of County Commissioners of the County of Itasca and State of Minne- sota, that said petitio{ be, and the same hereby is, approved and granted, and Be it further resolved that an elec- tion be held on the 26th day of April, 1911, at Woodman Hall in Section 28, Township 54, North Range 23, West in said Itasca County, said place being within the boundaries of the territory proposed to be incorporated, for the purpose of voting upon the proposition of the incorporation of said village; that J. F. Foley and Wm. F. McCaffery and Chas. W. Mattison, residents of said territory proposed to be incorporated, bé, and they are hereby appointed inspectors to act as judges of said election and to conduct the said election so far.as prac- ticable in accordance with the laws reg- ulating the election of town officers; and Be it further resolved that the county auditor forthwith cause a notice stating the time and place for holding such elec tion as above set forth together with a copy of said petition, to be posted in three public places within the boundar- ies described in said petition. Kiley as spokes- man appeared and laid before the Board the advisability of making a small ex- penditure for the purpose of advertising the agricultural resources of the Coun- ty with a view to inducing settlers to locate in the County and requesting the Board to consider the advisability of making an appropriation for that pur- pose., Upon motion the matter was laid over till the next meeting for further consid- eration. The Board then took ufder consider- ation the matter of necessary additional vault room for some of the County offic. es and after a careful consideration of the matter, Commissioner Shellman mov- ed that the County Auditor be instruct- ed to advertise for bids for the construc- tion of additional vaults for the offices of the Register of Deeds, Clerk of Court, and County Auditor, said improvements to be made according to plans and speci cations prepared by D. V. Case & Broomhall, Architects, on file in the office of the County Auditor. Bids to be received and opened at a meeting of the Board of County Commissioners to be held on the 4th day of May, 1911, at 10 o'clock a. m. The motion was seconded by Commis- sioner O’Brien and carried by.unanimous vote. Commissioner King moved that the committee appointed to examine the route of a highway in the Towns of Alvwood and Popple on the 26th day of April, be instructed also to locate a toute for a road from the townsite of Orth to the County road. Commissioners Shellman and King, members of the committee appointed at the meeting of the board held.on the.3rd day of January, 1911, to consider the advisability of the appointment of a tuberculosis saniturium commission, un- der the provisions of Chapter 347, Laws of 1909, reported that on account of matters now pending before the State ( Legislature, it is impossible to make any recommendation in regard to said ; Matter at this time. It being the time set for hearing upon the petition for the establishment of Toad No. 93, the committee appointed to examine the route of said road filed the following report: To the Board of County Commissioners of the County of Itasca, Minnesota. American Bonding Company of Balti- more in the sum of $5,000.00. Massachusetts Bonding and Insurance Company of Boston, Mass., in the sum lof $2,500.00. The Title Guaranty & Surety Company of Pennsylvania, in the sum of $2,500.00. United States Fidelity & Guaranty Com- pany of Maryland in the sum of $15,- 000.00. Making a total of $30,000.00. The sai surety bonds being furnished by said bank to take the place of the person- al surety bond of said bank now: on file in the office of the County Treasurer, which said bond was executed on the 29th day of May, 1909, in the sum of $30,000.00, with Jno. C. Greenway, Daniel M. Gunn, William C. Gilbert, Bernard C. Finnegan and Thomas Russell as sur- eties. All of said surety companies being li- censed to do business in the State of Minnesota and all of said bonds having been duly approved by the Coun- ty Attorney as to form and execution, Commissioner O'Brien moved the adop- tion of the following resolution: Resolved that the surety bonds of the First State Bank of Marble, Minnesota, as a county depository, in the aggregate sum of $30,000 with the National Surety Company of New York, as surety in the 80] sum of $5,000, American Bonding Com- pany of Baltimore, Md., in the sum of 35,000, Massachusetts Bonding and In. surance Company of Boston, Mass., im the sum of $2,500, The Title Guaranty & Surety Company of Pennsylvania, in the sum of $2,500, and the United Stat- es Fidelity and Guaranty Company of Baltimore, Maryland, in the sum of $15,- 000, be and the same are hereby ap- proved. The said bonds to be filed in the office of the County Treasurer of Itasca County, to take the place of the personal bond of said Bank on file in the office of said treasurer. The motion for the adoption of the resolution wes seconded by Commi sioner King and carried by the following vote. Yea: Commissioners O’Brien, King and Shellman. Nay: None. Commissioner Nelson not voting. A petition was presented for the es- tablishment of a highway beginning at the south quarter post of section 10, Township 60, Range 25, and running 3 miles on section line, thence north one half mile near the quarter line of Sec- tion7, of the said Township, thence west on the quarter line about one half mile to the range line, thence continuing west one half mile on one quarter line of Section. 12, Township 60, Range 26, thence north one half mile to section line, thence west one half mile, thence north abqut one and one half miles and connecting with town line road. Commissioner Nelson moved that a hearing be had upon said petition at the Court House in the Village of Grand Rapids on Thursday the 8th day of June 1911, a§ 10 o’clock a. m., that Commis- sioners M. O’Brien, C. M. King and A. Nelson, be appointed a committee to examine the route of said proposed road, that said committee meet at the point of termination of said route on Tuesday the 6th day of June, 1911, at 3 o'clock p. m. for the purpose of ex- amining said route and that said com- mittee make report to this Board at the time set for hepring upon said petition. The motion was seconded by Commis- sioner King and carried by unanimous vote. The County Surveyor was instructed to make a survey of County Road num- ber 89, in Township 55, Range 27. A communication from S. G. Iversom State Auditor, in regard to the organiz- ed Town of Lincoln, was read. Said communication advised the Board that prior to the organization of the Town, of Lincoln in Itasca County, a Town was organized under that name in the County of Blue Earth, and the Board was requested to select another name for said Town. Commissioner King moved the adop- tion of the following resolution: Whereas at a meeting of the Board of County Commissioners of Itasca Coun- ty, Minnesota, held on the 7th day of March, 1911, Townships 53, Range 26, an 53, Range 27, were organized into a new Town under the name of Lincoln, and Whereas the County Auditor of Itas- ca County, did theraafter transmit to the State Audior an abstract of organiz- ation of said Town, and Whereas, the State Auditor has notified this Board that prior to the organization of said Town, there was organized in the Coun- ty of Blue Earth a Town under the name of Lincoln, and that it is neces- sary to select a new name for said Town as provided by Sec. 457 of the Re- vised Laws of 1905. Now therefore be it resolved that the name of said Town so organized be changed from ~incoln’’ to “Spang’’ and that hereafter said Town shall be know and designated as the Town of Spang. Resolved further that the County Au- ditor be instructed to forward a copy of this resolution to the State Auditor, The motion to adopt the resolution was seconded by Commissioner O'Brien and carried by unanimous vote. A communication from County Attor- ney McOuat requesting the Board to make a further appropriation for the County Attorney Contingent fund, was presented and read, Commissioner King moved the adop- tion of the ‘following resolution: Resolved that the sum of $250 be and the same is hereby appropriated from the County Revenue Fund to the Coun- ty Attorney Contingent Fund. The motion to adopt the resolution was seconded by Commissioner O'Brien and carried byunanimous vote. A petition was presented for the sur- vey of Section 36, Township 56, Range 26. Commissioner King moved that a hear- ing be had upon said petition at the Court House in the Village of Grand Rapids on Thursday the 4th day of May 1911, at 10 o’clock a. m. The motion wa seconded by Commissioner O’Brien and carried by unanimous vote. Commissioner Nelson moved that the County Auditor be authorized and in- structed to procure a list of all liquor licenses issued by the Councils of the various Villages of the County, since the 1st day of January, 1910, for the purpose of determining the amount due the County, in accordance with provi- sions of Chapter 450 of the Laws of 1909, on account of the issuance of such licenses, The motion was seconded by Commis- sioner O’Brien and carried by unant- mous vote. A petition was presented for the es- tablishment of a highway beginning at the Northeast corner of the northwest quarter of section two, in Township 146, of Range 26, and running thence south along the quarter line in said sec- tion to the northeast corner of the south east quarter of the southwest quarter ef said settion; thence east to the northeast corner of the southeast quart~- er of the southeast quarter of said sec- tion two; thence south on section line to the northeast corner of section four- teen in said township; thence east along section line to the northeast corner of the northwest quarter of section thirteem in said township; thence south to the northeast corner of the southeast quart- er of the northwest quarter of sail sectio;n thence east to the northeast corner of the southwest quarter of the northeast quarter of said section; thence south to the northeast corner of the northwest quarter of the southeast quarter of said section thirteen; fhence east to the northeast corner of the southeast quarter of said section thirteen; thence south on town line to the north- east corner of section twenty-four in said township 146 of Range 26.
