King, Deer River; Disirict No. 2—Morme O’Bren Cohasset; Dittrict No. 3—Amdy Nel- eon, Bovey; District No. 4—Neii Mul- Mus, Laprairie; Detrict No. 5—Jno: i, Sheliman, Nashwauk. Commissioner Ne® Mullins was elected Chairman of the board for the ensalmg year by unanimous vote. Commissioner Jno. L, Shellman was eloctat vicechairman for the ensuing year by i vote. Upon motion of Commissioner O’- Brien seconded by Commssioner King, the bond of the county attorney wilh Raymond A. McOuat as: princ.pal and the American Surety company, of New York as surety, in the sum of $1,000.00 was approved by unanuous vote. Upom mation of Commissioner O’- Brien, seconded by Comm/ssioner Km the ponds of the following county oificers were approved by un- amicus vote: County Auditor with ™. A. Spang as principal and the American Surety campany of New York surety, in, the sum of $3,- 000. Coroner, with Thos. Russell as principal and W. C. Gilbert and B. C. Finnegan as suretios, in the sum of $1,000.00; Court Commissioner with W. B. Taylor as principal and Henry H. Herre'd and Thos. H. Martin as sureties, in the eum of $2,- 000.00 Upon motion an adjournment was then taken to 1:30 o’clock p. m. Pursuant to adjournment the board again vot at 1:30 p. m. Ail members. present, Upon motion of Commissioner Shell- man the board went into executive aession at 2:15 p. m. . At 3:15 p. m. the’ board resumed bus ness in regular session. Commissioner Shellman moved the adoption of the following resolution: “Resolved that the amount for clerk hire to be allowed the county treasurer for the ensuing year be and the same is hereby fixed im the sum of $600.00.” The motion was secanded by Com- missioner O’Brien ana carned by un- animous. vote. . Commissioner O’Brien moved the adoption of the following resolution: “Resolved that the sum of $250.00 be and the same is hereby appropriat ed from the. county revenue fund to the county attorney’s contingent fund.” The motion was seconded by Com- missioner King and the resolution was adopted by unanimous vote. Commissioner O’Brien moved the adoption of the following resolution: “Resolved that the sum of $350.00 be and the same is hereby appropriat ed from the county revenue fund to the imcidental fund.” The motion was seconded by Com- missioner Shellman and the resolu- tion was adopted by unanimous vote. Uniess other preliminary motions are interposed within the next ten days the effect of Judge Carpenter’s ruling will be the immediate arraign- ment of the packers, who are under criminal indictment for alleged viola- tion of section 2 of the Sherman anti- trust act, which makes every con- spiracy or attempt to monopolize any part of the trade or commerce among the states or foreign nations a misde- meanor punishable by fine and impris- onment. As soon as it became known in Washington that the federal court had shattered the “immunity” plea of the packers orders were sent to the gov- ernment lawyers to meet there as soon as possible for a conference, History of the Case. The government filed a bill in equity im the United States district court for the Northern district of Mlinois in 1902 against . twenty-six meat packers, charging a combination to restrain competition in violation of the Sher- man act. The case came first before K. M. Landis, who, having been attor- ney for several of the packers before ‘taking his seat on the federal bench, was ‘disqualified, and the case was heard by Judge Peter Grosscup. The injunction was granted and made permanent and on appeal to the United Ste supreme court af- firmed. Two vears later the National Packing company, a holding concern, was organized to take over the of ‘numerous independent packing companies and issue its own stock in return. Injunction proceedings were brought against the National Pack- ing company and were pending at the time the indictments were filed against the individual packers. These injunction proceedings have since been withdrawn Last July the federal grand jury returned true bilis against Louis FP. Swift, Edward F. Swift, Charles H. Swift, Frank A. Fowler and Edward Tilden, of Swift & Co.; J. Ogden Ar. mour, Arthur Meeker and Thomas J. Connors, of the Armeur P; company, and Edward Morr Louis H. Heyman, of Morris & Co. The indictments alleged violations of the Sherman t subsequent to the Grosscup injunction and were in line with the government’s policy to at- tack wronkdoers individually as well as corporately. : Packers Not Yet Arraigned. Various dilatory moti have been entered since the indictments i a and the packers have not yet been arraigned. The last and most bit- terly fought contention was that the government, having obtained an in- junction, any subsequent violations of the Sherman act were in contempt of court. The packers attempted to have the indictments quashed on this ground, thus making the injunction a bar to any subsequent criminal proceedings and themselves immune from punish- ment other than the court may in- flict of its own initiative by way of fine against the corporations enjoined. Judge Carpenter held that the gov- ernment, by proceeding in equity to enjoin a continuing violation of the Sherman act, does not thereby confine itself tc that procedure but may prosecute criminally for distinctive violations, subsequent to the injunc- tion.
