An ordinance to regulate the stor- age, keeping, selling and conveying of gunpowder, dynamite and other explosives, and the use thereof in blasting within, the Village of Kee watin and providing a penalty for the violation thereof. The Village Council of the Village of Keewatin’ do ordain: Section 1. It shall be unlawful for any* person, firm or corpotation to have, keep or store any gunpowder, dynamite or other explosive in. store, dwelling, building place within the limits of the Village of Keewatin without a permit there-| GRAND RAPIDS HERALD-REVIEW "WEDNESDAY, NOV. 9, 1910. Any person, firm or’ cor- poration desiring. a permit to have, keep or store any gunpowder, dynamite or other explosive within the Village of Keewatin shall make application therefor in writing to the Village Council; such application shall state the name or names of the person or firm, and the officers and names of Officers, if it be a corpora- tion, the kind, quantity and place of storage for keeping of such explosive. If the Village Council shall deem it expedient and proper to grant such permit, it shall instruct the Village Clerk to issue such permit to such person, firm or corporation, which permit shall state the quantity, kind and place of keeping or storage of such explosive, and the length of time such permit is to run. No such per- mit shall extend after the first Mon- day in April next succeeding its issuance. No such permit shall be transfer- able and such permit shall not auth- orize the keeping or storage of such explosive in any other place than the one named in such permit. | Sec. 2. It shall be unlawful for any dealer in gunpowder to have and keep in stock more than ten pounds of any gunpowder or saltpeter in any building or place of business within the Village of Keewatin, at any one time. And the same shall be kept in metallic cans with close-fitted and well secured covers thereon. Sec: 3. Every retailer or dealer in explosives shall have and keep posted conspicuously on the outside of his place of business a sign bearing the words: “Gunpowder and Explosives \for Sale,” the letters on which sign (shall be at least three inches high ,and two inches wide, and which sign shall be posted in plain sight of passers by. Such dealer shall also |notity the fire warden, in writing, of {the keeping of such explosive, stat- ing specifically in which portion of such building such explosive shall j be Kept. | Sec. 4. No person or persons shall carry or convey any of the explosives | mentioned in section one of this ordin- ance, or any other explosives, in any vehicle in the Village of Keewatin unless the said explosive shall be | securely enclosed in a tight package {and so carried as to be safe from | sparks, fire and jolts or jars. | Sec. 5. It shall be unlawful for any person, firm or corporation to suffer or allow any agent or employee for them, or to themselves sell or handle any explosive between the hours of sunset and sunrise of any days, or by the light of any artificial light, unless such explosive is in an original and tight package. Sec. 6. Nothing in this ordinance shail be construed to prohibit any person, firm or. company habitually using explosives for blasting within said Village from keeping on hand a | sufficient supply for their needs, not te exceed fifty pounds of any such explosive, the same to be kept in a building situate separate, from any building occupied by human. beings toa distance of at least three hundred feet, or kept underground in such | shape and condition that.the explo- sion thereof could not injure any human being residing or being in the vicinit; - Sec."7.’ It shall be» unlawful for ‘any person’to discharge “any blast within the Village of Keewatin un- less the surface of the ground under wnich the same is placed shali be fully protected by logs and timbers in such manner as to prevent the fly- ing of stones and earth by such blast. Sec. 8. It shall be unlawful for any person to fire any blast of explosives within the Village of Keewatin with- out at first giving timely warning to apy and all persons who may be in the vicinity at such time. Sec. 9. It shall be unlawful for any person, firm or corporation, either by itself, for its agents and employees to jleave or allow any explosive sub- stance to remain or lie about where the same can be handled by any persons not authorized to handle the same, or to leave or allow any such explosive to be or remain within such distance from any blast b fired that the same could be fired by the explosion of such blast. Sec. 10. Any person violating any of the provisions of this ordinance shall on conviction thereof be pun- ished by a fine of noi less than twenty- five nor more than one hundred dollars and the costs of prosecution, or by imprisonment for not less than thirty nor more than ninety days. And upon default in the payment of such fine and costs may be ‘im- prisoned in the Village jail until the same be paid, not exceeding ninety days. Sec. 11.
