Section II—It shall be unlawful for any person to dig up or haul a- way from any street, avenue, alley or public ground ‘within said village any gravel, sand dirt or earth, with- out first having obtained the consent of the village council. Section III—It shall be unlawful, within the limits of the village of Calumet, for any person to erect or maintain, or cause to be erected or maintained above, over, across or sO as to extend upon any street or sidewalk or avenue, any sign, wood- en awning, swing sign or advertise- ment or any sign post or bill board whatever, or any cloth awning which ig less than seven (7) feet in the clear above the street or sidewalk over which said cloth awning is to hang! or be suspended. J : Section IV.—Any person violating any of the provisions of this ordin- ance shall, upon conviction thereof by any court having jurisdiction, be punished by a fine of not less than One Dollar ($1.00) nor more than Twenty-five Dollars ($25.00) and the costs of prosecution, and im default of payment thereof he shall be com- mitted to the village watch-house or be imprisoned in the county jail of Don’t you need a new pair? Section IV.—If any person, being the owner or occupant of any premis- es, buildings or grounds within the limits of the village of Calumet, hav- ing any snow, dirt or rubbish upon the sidewalks or any rubbish or gar- bage upon the streets or alleys op- posite thereto, shall fail to remove such snow, dirt, rubbish or garbage within twenty-four (24) hours after notice has been given to him by the village marshal of said village, as provided in the preceding section then, in that event, such snow, dirt, rubbish and garbage shall be removed by the street commissioner of said village, and the expense thereof shall become a lien upon the real estate opposite and contiguous to where such expense is incurred, and shall be extended against such pro- perty and be collected in the same manner asother special taxes are levied, assessed and collected. | Section V.—This ordinance shall take effect and be in force from and after its passage and publication. Ordinance No. 17 An Ordinance Providing for Preven- tion of Fires and Prohibiting Acts That Have a Tendency to Create Fires, and Providing Penalties for the Violation Thereof. The Village Council of the Village of Calumet, Itasca county, Mimnesota do ordain as follows: Section I—It shall be the duty of the owner or occupant of any buildin; in the village of Calumet to cause the chimneys thereof to be burned out, swept or otherwise cleaned when ever required to do so by the fire warden of said village. Section II.—It shall be unlawful for any person to keep or maintain a hole im the chimney for a stove pipe unless the same shall be provided with a thimble of ‘sheet iron or oth- er fire proof material imbedded in mortar, and also a tin or sheet iron stopper with a diameter at. least two inches greater than the diameter of tthe hole in which’ the same is insert- ed and it shall be unlawful for any person to paper over or cover any such hole with paper or other com- af le material. “ Section HI—It shall be the duty of the owner or occupant of a build- ing used as a blacksmith shop, coop- er shop or other manufacturing in- stitution using light fuel or a forc- ed draft, to so construct the chimney thereof or to provide the same with spark arrester so as to prevent sparks or fire from passing into the open air, Section [V.—It shall be unlawful for any person to keep or maintain amy stove pipe unless the same be conducted into a chimney of brick or stone or to maintain any stove pipe within twelve (12) inches of any wood unless such stove pipe shall be double. with ati least one inch air space between the imner and outer portions thereof. Section, V.—It shall be unlawful for any person to keep any stove in any building unless the floor beneath the same ‘shall be protected by some in- combustible material; or for any per- son to keep or maintain any stove within twenty (20) imches of any woodwork, unless such woodwork is protected by some incombustible ma- terial. Section VI—It shall be unlawful for any person to keep or maintain a stove fin a place where ‘hay or straw is kept, or where shavings or other combustible materials are made or stored, unless such stove is set in a box surrounded with incombustible material. Section VII—It shall be unlawful for any person to carry fire through any street, avenue, alley or public ground, or across any lot in the vil- lage of Calumet, unless the same is placed or carried in a close or se- cure pan or vessel. Section VIII it shall be unlawful for any person to keep or deposit ashes in the village of Calumet, un- less the same are kept or deposit- ed in p close and secure metalic or earthen vessel or brick or stone sub- rdom. * Section IX.—All persons following any trade of business by which shav- ings are made shall cause the place where the shavings are, to be cleaned out each evening, and shall cause such shavings to be carefully gather- ed and stored! fn a tight box or oth- er receptacle, which shall be kept securely covered at all times, or shall cause the same to be burned at the time such place is cleaned, at some place distant at least one hundred and fifty feet from any building. Section X.—It shall be unlawful for any person to scatter any chips, shav- ings or other combustible material in any of the streets, avenues, alleys or public grounds, or upon any vac- ant lot in the village of Calumet. Section XI—It shall be unlawful for any person to keep or store any packing boxes, barrels, cases of wood or other refuse from any store or plac of business upon any vacant lot or open space in the Village of Calumet, | without written permission from the fire warden. : Section XII.—It shail be unlawful for any person in the village of Calu- met to have in his possession any oily waste, rags or other material saturated with oil, or other imflam- able substance, umless the same shall be emptied each evening and its con- tents ‘burned or otherwise destroyed. Section XIII—It shall be unlawful to keep or use any light in any stable or other place or building where hay, straw or other combustible materials are kept in the village of Calumet, or in any basement or any building in said village, unless the same shall be securely enclosed in a lantern or other suitable tovering. ‘Section X1V.—It shall be unlawful for any person in the village of Calu- met to keep or use any swinging or movable light where the same may come in contact with any woodwork, curtains or other combustible ma- terial, unless the same shall be pro- tected by a screen or other sufficient guard. Section XV.—It shall be unlawful for any person to keep or use any are light in any building or other place in the village of Calumet where combustible materials are kept or stored, unless such light is protected by a) sufficient wire ecreen. Section XVI.—It shall be unlawful for the owner or lessee of any em- pty house, barn or other building wit) in the village of Calumet, to permit the same to remain open or the open- ing thereof unfastened. Section XVII.—All buildings now in the village of Calumet and all build ings to be hereafter erected or con- structed therein, shall have sufficient and perfect brick chimneys, which shall extend at least three (3) feet above the roof of such building. All blacksmith shops shall have chimneys constructed of brick, lime and sand and mortar and completely plaster- ed inside and it shall be unlawful for any owner or occupant of any building to maintain or permit in such building any chimney not con- structed and kept as in this ordi- nance specified.’ Section XVIII—It shall be unlaw- ful for any building on Gray street, in said village of Calumet, whether heretofore constructed or hereafter to be constructed, toi have on the out- side thereof and as part of said build- ing, tar paper or other combustible material, unless the same is covered with wooden or other siding materi- al; and in the case of buildings here- tofore constructed on said Gray St. the owners and occupants thereof shall have thirty, (30) days after the passage of this ordinance in which to make the said building conform to the requirements hereof. Section XIX.—Any person who shall violate any of the provisions of this ordinance shall, upon con- viction thereof by any court having jurisdiction, be punished by a fime of not less than One Dollar ($1.00) nor more than One Hundred Dollars ($100.00) and costs of prosecution, and im default of payment thereof shall be committed to the village watch-house, or be imprisoned in the county jail of Itasca county until such fine and costs are paid, not exceeding three months.
