All the members of the council were present and the meeting was duly called’ to. order by the president. Trustee Leroux offered the follow- ing resolution and moved its adoption : Resolution. Whereas, pursuant to resolution du- ly adopted by this council on the 12th day of July, 1909, this Council met on the 26th day of July, 1909, at 8:00 o’clock p. m. ,for the purpose of receiving, opening and consider- ing bids for the paving of -Third street in this Village, from a point 200 feet east of Leland avenue to the east side of Clough avenue with Rudolph S. Blome Company’s paten- ted granitoid (concrete) pavement together with curbing and guttering and the necessary grading and ex- cavating therefor; and, whereas, bids of Hugh Steele and Rudolph S. Blome Company, a co-partnership, for the doing of the work and the furnishing of the materials contemplated by said resolution have been duly receiv- ed, opened and considered; and where as, the bid-of said Rudolph S. Blome Co., is as follows: Paving $2.00 per square yard; excavating $ .25 per cubic vard, curb and gutter $ .55 per limeal foot; and, whereas, said Ru- dolph S. Blome Co., have complied with all the requisitions of said reso- lution and the plans and_ specifica- provisions of law applicable there- to, and have agreed to furnish a li- eense to said village from the paten- tee of said: pavement to lay and relay the ‘same for all time hereafter, free from all claims of royalty, = to guarantee to the satisfaction of! council the performance of said work, and have agreed that all work to connection with crushing Gommissianes McWilliams and done the for said improvement shall be done in the town of Grand Rapids; ‘and, whereas, said Rudolph S. Blonie Co., are the lowest responsible bidders for said work and are so deemed by this council; and, whereas, this coun- cil’ deem it for the best interests of said village and all concerned that the improvement aforesaid include a driveway twenty-seven feet in width, together with curbing and. guttering as'in said resolution, plans and speci- fications contemplated and the neces- viral grading and: excavating there- Now, Therefore, be it resolved that said proposed improvement, consist- ing of a driveway twenty-seven feet wide, together with such curbing gut- tering, grading and excavating, and other work necessary and incidental thereto, in accordance with the afore- said resolution and this resolution, including the recitals in said resolu- tions, and said plans and specifica- tions, be duly constructed and mad and that the bid of said Rudolph S. Blome Co., for, the making of said improvement, and the doing of the work, and furnishing of the material therefor, in accordance with said re- solutions, plans and_ specifications, | be and it is hereby accepted; that the president and recorder be and and they are hereby authorized and \directed, on behalf of said Village, to enter into and execute a contract with said Rudolph S. Blome Co., in agcor- dance herewith; and that the amount of the bond of said Rudolph S. Blome Co. in conmection with said contract be and it is hereby fixed at the sum of Twenty five thousand Dollars, aid bond to be conditioned in accor- dance with law and with said resolu- tions, plans and specifications, and to be executed by said Rudolph:S. Blome Co. as principals and by a Surety company, duly authorized to transact business in the § state of Minnesota, as surety. Said motion was seconded by Trus- tee Remer and put to a vote. A ma- jority of the members of the Council voting in favor of same, said motion was duly carried and said resolution adopted, and so declared. The Village Attorney was instruct- ed to take up with the Great Nor- thern Railway Co. the matter of cleaning up their right of way on the north side of Third street. Ordinance No. 63, entitled, “An ordinance relating to and requiring the removal of the poles of the Mesaba Telephone Company, from that part of Third street between a point 200 feet east of Leland avenue and the east side of Clough avenue,” was in- troduced by trustee Remer, and on motion duly made and carried, the same was placed on its first reading. On motion duly made and carried ordinance No. 65 was passed to second reading. On motion made and car- ried, ordinance No. 63 was advanced to its third and final reading, passed and adopted, and ordered to be pub- lished according to law. On motion the Council adjourned. . W.
