Now therefore, As conclusions from the foregoing findings, we, the County Board of the County of Itasca, State of Minnesota, at said special session of said board, held at ‘the time above specified, being satisfied that the pro- posed ditch will be of public utility and conducive to public health and public benefit and convenience, do y locate and establish the said ceording to the report and the ations of said civil engineer » and filed herein: and do hereby establish and confirm the report of the viewers made and filed herein. The board then p.m Pursuant to adjournment, again met at 1:30 p. m. ‘All members of the board present. Commissioners Mullins, O’Brien and Passard were appointed a committee to examine the work done on_ the y-Bovey road, under the Melvin holt ‘contract. The committee to examine said road on Monday, Nov. 20, 1908. A delegation of citizens of Calumet before the board and requested board to furnish police protection at Calumet. After carefully consider- ing the matter ‘the board were of the opinion that they ‘had no legal right to furnish police protection at the ex- pense of the county, and therefore no action was taken. Commissioner O’Brien moved that the matter of appropriation for bridges in the Town of Balsam be laid over to the annual January meeting. The motion was seconded by Commissioner Sundloff and carried by unanimous vote, Two applications for abatement of penalty interest and cost by Wm. Per- Fington, also the application of the county auditors for taxes erroneously assessed against certain lote in the vil- lage of Grand Rapids were approved and recommended to the Minnesota tax commission: The petition of Victor J, Benoe for appointment as inspector of mines was then presented. Commissioner Sund- loff_ moved that the petition of Victor J. Benoe, also the petition of Peter L. Ramquist for appointment as inspector of mines, be laid over to the annual January meeting. The motion was sec- onded by Commisisoner O’Brien and carried by uanimous vote. Commissioner O'Brien moved the adoption of the following resolution: “Whereas, by order of the district court of Itasca county, Minnesota, dated May 5, 1908, and by order amend- ing said order dated June 24, 1908, in the matter of the petition of George O. Welch and others for the establish- ment of a public ditch in the counties of Itasca, Aitkin and St. Louis, in_said state, to be known as ‘Judicial Ditch No. 1,’ said ditch was duly established, and by and pursuant to said order cer- tain assessments were duly made against private and state lands and public and corporate roads in said counties for their respective shares of the cost thereof, (to which order and the proceedings theretofore and there- after had in said matter reference is hereby made for further details con- cerning the same); and whereas pur- suant to said order the county auditors of said counties, in behalf of said counties have duly let and entered into | loft, jt a contract for the construction of said ditch, and the expense incurred and to be incurred in locating, constructing and establishing so much of said ditch as is and will be located within said Itasca county aomunts to the sum of Thirteen Thousand Five Hundred, Forty-six 66-100 Dollars, and whereas proceedings have been duly taken to secure a lien on said private and state lands and said public and corporate roads in said Itasca county for their respective proportions of such ex- pense; “Now, therefore, be it resolved that said Itasca county, Minnesota, issue its bonds in the aggregate sum’ of Thir- teen Thousand Five Hundred, Forty- six 66-100 Dollars, to defray, in whole, the expense incurred and to be jin- curred tin locating, constructing and ablishing so much of said ditch as is and will be located within said Itasca county, such bonds to be dated January 2, 1909, payable in fifteen annual installments, on or before the second day of January of the year 1915, and of each of the fifteen years thereafter, and to bear such rate of interest not exceeding six per cent per annum, Racers, semi-annually, as may be provided for in the bid.’ therefor which shall be most favorable and ac- cepted by said county, provided, that if before the issuing of bonds there shall be paid into the county treasury of this count the sum of $1799.33, the amount essed in said proceedings against st lands, then the agrgegate amount of id bond issue shall be $11,747.33, payable in equal installments iin time and man- ner, and with interest as aforesaid. “Be it further resolved, that this Board meet on tne 19th day of De- cember, 1908, at 106 o'clock a. m., for the purpose of receiving, opening and considering such bids as may he of- fered for such bonds, and of selling said bids, if a satisfactory bid be re- ceived; that, before any such bids be considered, it shall be accompanied with a certified check, payable to the treasurer of said county, in at least the sum of One Hundred Dollars, guaranty of the performance the if accepted: and that the county itor of said county be and he is * orized and instructed to give notice of the proposed issuance of said bonds, s and conditions thereof; : e and place fixed for re ceiving, opening and considering bids for same, by publication of such notice once in each week for two successive weeks, forthwith, in the Grand Rapids Herald Review, published at Grand Rapids, Minnesota.” The motion for the adoption of the foregoing resolution was seconded by Commissioner Passard and carried by a a oner O'Brien moved that in- mates at the county poor farm be prohibited from leaving said farm wita_ out permission from the overseer. Upon motion of Commissioner King, seconded by Commissioner Passard the purchasing committee were instructed to purchase the necessary clothing and bedding for the county poor farm. Mr. Sundloff moved that W. —. Mar- tin, be instructed to immediately take steps to make the necessary report of work done upon the state road, for the state higaway commission. Commissioner Sundloff moved that the report of the committee be ap- proved; that said highway be and the same is hereby established according to the committee's report; and that the advantages and benefits to each des- eription of land over which said road runs be and are hereby assessed equal to the damages sustained. The motion was seconded by Commissioner Pas- sard and carried by unanimous vote. It being the time set for hearing upon the petition for the establish- ment of a highway known as the Bliss read, beginning at the one-eighth post west of the quarter post of section 16 and 21, township 54, range 24. and running thence in a northeasterly di- rection to the one-eighth post east of the quarter post of sections 4 and 9. of said township 54, range 24, and there connecting with the road leading to Grand Rapids. the committee ep- pointed to examine the route of said ed; that said highway be and the same is hereby ordered established, accord- ing to the committee’s report, and that the advantages and benefits to each description of land over which said road runs be and the same are hereby assessed equal to the damages sus- tained. The motion was seconded by Commissioner King and _ carried by unanimous vote. It being the time set for nearing upon the petition for the establish- ment of a hignway known as the Spring Lake road, beginning at the center of section 8 township 148, range 25, and running thence in a westerly direction to a point one- quarter mile north of the center of section 11, township 148, range 27, the committee appointed to examine the route of said road filed a report in which they recommended that the prayer of the petitioners be granted. Upon motion made and carried, the hearing upon said petition and the re- port of said committee was adjourned to the next meeting to be held on De- cember 19th, 1908, and the county sur- veyor was instructed to make a sur- vey of the route of said road and file a report thereof in the office of the county auditor. The board then adjourned p.m. Pursuant to adjournment the board again met at 7:30 p. m. Members present: Commissioners Mullins, King, Passard and Sundloff.
