HUSON. general laws of the state of Minnesota, for | shill be levied, for the fiscal year next ensu- | nnéil the | | i | DRAINAGE BILL. af THE COLE The full text of the bill introduced by Representative Cole for the drain- age of swamp lands is here given: To provide for a comprehensive system of drainage or all the swamp and marshy layds of the state; to create a comm priate money to carry out Lhe provi- sions of this act Whereas, by acts of congress of February, 1850, and Marclr 12, 1860, there was granted to the state of Minuessta by the United States of America upwards of five million acres of swamp lands situated in different counties of the state, of which more ; than two million-acres remain unsold and disposed of, which Jands in the present condition are wortless for agricultural purposes. but which if properly drained will be worth many million dollars and the public bealth aud convenience iwproyed thereby. Whereas, by the acts of congress granting said Jands it was provided that the proceeds of said lands, whether frum sale or by direct appro- priation in kind, shall be exclusively applied as far as pevessary to the purpose of reclaiming said lands by means of levees and drains, and there- fore, Be 1t enacted byythe legislature of the state of Minnesota: Section I. That a commission, consisting of the governor, the state auditor and the secretary. of vhe state, be and the same is, bereby created, to be known as the drains age commission of the state of Minneso The governor shall be the chairman of said commission and preside at all its meetings, and the majority of all members of said com- mission shall bave authority in all Inatters and to perform all duties required to be performed by said comission. Section 2. It shall be the duty of said commissior as soon as is practic- abie after the passage and approval of this act to auvcertain the number of acres of low, wet tands belonging to the state that it is necessary to drain in order to make them fit for agricul- tural purposes, and where the same is located and what ditches and drains ib will be necessary Lo construct to drain the said land. In the execution of the provisions of this act, the said commi ion shall have full power and it is hereby authorized and directed to cause to be made & complete and accurate survey of location, size, route, begin- hing and termination of a comprehen- sive system of ditches or drains sufti- cient in number and size and length- aud so located as to drain in the most fesaible and practicable manner all low, wes and swamp lauds owned by the state. And to accomplish sach purpose, said commission is authorized and directed to employ within a reason- able time after the approval of this ach, one or more competent civil, | hydraulic or typographical engineers aid such other ageuts and assistants ws it may find necessary and proper to comply with the provisions ef this ct, and to fix the salary or compen- sation to be paid such employes. Such ehgineer, or engineers, shall upon appointment ab once proceed under the direction of said commis- sion to make the necessary levels of all low, wet or swamp iands owned by che state and shal] as soon as prace able. lay outa complete plan of a stem of drains or ditches which shall in the most feasible and practic- way, when completed, drain such lands aud fit them for the pur- pose to which they are by nature adapted. Such engineers shall keep an accurate and complete set of field notes and shall make a complete map and report of the said system of able | drains determined and found to be the most feasible, practicable and best calculated to accomplish he desired end, which map shall show the loca- tion, length, width and depth, the beginning, course and termination of each proposed drain or ditch in the system, and which report shal! show the legal description of each tract of land according to government sub- divisions, necessary to be jaken or nterfered with in order to construct said system of drainage, and shall show the estimated cost of construc- tion of each diteh, and the entire system so laid out by them, according to their best judgment. Section 4. Upon the completion of his work said engineer or engineers shall place in the hands of the said commission not later than November 1, 1905, all his field notes, maps and reports which shall become the ex- clusive property of the state of Minne- sota. Said commission shall at once cause said maps, fleld notes and: | reports to be filed in the office of the State anditor and shall make a com- plete report of the doings of the coni- mission under this act, with an item- ized account of its expenditures and containing a statement of the owner will require to be taken or interfered with, uccording to the report of the ion and +0 appros| ship. with or by the state or by pri-* vate Gwners, of all tbe lands which | engineers, in order to establish said system of drains, which report shall embody the map and report of the engineer or sufficient thereof to enable the legislature to obtain an intelli- gent idea of the subject, together with such suggestions and recommen- dations as the commission may think proper. A sufficient numbers of copies of the report of said commission shall he printed and furnished to the mem- bers of the legislature which will convence in the year 1907, and the various officers and boards of the state. 1 Section 5. For the purpose of carrying vut* the provisions of this act, there is hereby appropriated out. of the moneys in the state treasury, not olberwise appropriated, the sum of twenty-five thousand dollars. Section 7. This act shall take effect from and after its passage.
