Swamp and Other Lands, The pleasing announcement is con- tained ina Washington special that the department of interior has:made importment wodifications of the rul- ing on swamp land cases that tbe surveyors’ ftleld notes shall always govern as to. the charcter of the land, says, the Duluth Herald. For some time past a strong effort has been made to obtain a reversal of this rul- ing, which has turned “over to the state and thence to railruads, as part of their, swamp land grants, many thousands~ of acres of land that is certainly not swamp now, whatever it may have been at the date of the field notes. Lt was with a view of correcting this manifest in- justice that Congressman Bede re- cently ,introduced a bill providing that when a settler proved that a’ tract of land marked swamp was ever balf high and dry he should be allowed to make entry on it. At ouce. the state auditor protested against. the passage of the bill and the attorney general was sent to Washington to present an argument in favor of the unjust system. It is significant that the land office has now :ecommended modifications of the ruling that grant part of what the Bede bill provides for,and the sec- retary of theinterior has approved the recommendations. Oue modification of the ruting is the case of squatters on unsurveyed tuwships whose lands, when the towns are thrown open to settiement prove by the surveyors’ notes to be swamp lands. Hereafter these squatters will be permitted to offer proof that the Jands are not swamp. The other modifi-ation is that the Jands on the recently opened Chippewa reservation classed as swamp shall be resurveyed where proof is offered that fraud and gross irregularities attended the survey. These are two important steps in the right direction, and will do much to correct the injuctice that has been perpetrated and which has retarded the settlemeat and development of this section of the state. ‘he mem- bers of the next legislature from the northern portion of the state should aiso unite in a movement to secure legisiation providing that the rail-, roads shall makeall their selections of swamp lands to complete their grants within six months after the passage of the bill, and that there- after all state lands shall be sold at low rates to actual settlers or opened toentry under a state homestead law Easiiy Verified. “Editor Kiley calls Editor Anderson a ba- boon.
