The Duluth News Tribune gives the following report of the outcome of | the case, which was tried before Judge Lochran last week: “Some of the mystery concerning what is con- sidered “dead” in connection with “dead and down” logging operations Oo the Chippewa reservations of northern Minnesota is cleared up by adecision of Judge Lochren in the the senior member of which firm is stopping at the St. Louis. The firm protested, and declared that, if the government woul] return what money had been paid, it would be glad to leave the logs where they were. The offer was declined, as were other offers to ad- just the matter, but, West & Bonness retused to pay the trespass figures, and suit was brought to compel them. The action involved about $6,400, but the result of the case was of special interest, as it would seta precedent for other cases involving the same principles West & Bon- hess won out. The suit arose out of of the method of Mr. Farr in describ- ing green timber. He held thata tree showing any green branches should not be cut under the dead timber act, or any tree showing con- ditions pointing to its early decay should be logged, in order to preserve the timber. He considered that the scope of the dead and down act was intended to preserve the timber that was dying. Mr. Farr’s method of scaling was also one of the points at issue. He figured the solid contents of the tree, insteat of board measure. Judge Lochren held that Mr. Farr’s method of scaling was improper, and that the judgment of the logging su- perintendeut, Mr. Young, was bound to be the best as against that of Mr. Farr. Mr. Young. based his ideas of dead timber on the general conditions of the tree. The Canadian Way. The following is clipped from the Ft.
