BY the Associated Press. Jerry McCarthy, customer’s man of W. E. Hutton & Co., asserted at a Se- curities Commission hearing yester- day the Hutton firm had no financial responsibility in the Atlas Tack stock deal, which led to the commission's NG STAR, WASHINGTON, manipulation charges against the con- cern. Jacob Gruber, commission counsel, said the company had committed itself to advance more than $300,000 to help a group of five persons, including Mc- Carthy’s two sisters, to acquire 37,631 shares of the stock for resale through the company to 18 customers who had agreed to buy it. “My sisters,” McCarthy asserted, “understood that if any of the Hutton custcmers falled to buy the stock, they (the sisters) would be liable for their share, two-fifths, of the stock that was not placed. Did Not Reveal Link. McCarthy sald he did not inform his employers that his sister: were as- sociates of Herbert J. Adair of Wash- ington in selling the stock to the Hut- ton customers. Mitchell bought 1,000 Atlas shares. “It (the $2,633) was purely a gift, “and I thought it was a very generous action,” McCarthy said. Gruber contended McCarthy re- ceived the gift because of a profit Mitchell made on another stock. The Government attorney asked if the money transfer did not violate a New York Stock Exchange rule prohibiting customer’s men from receiving inoney from a customer’s account. “No,” McCarthy said, “it was a pure gift.” Sales for Investment.
