CHARGE OF P.W. A GRAFTIS QUASHED D. C. Court Throws Out Indictment Naming Seven in Texas Case. One of the first major charges of graft in connection with the spending of P, W. A. funds was thrown out of court yesterday with the quashing of an indictment against seven men. Justice Jesse C. Adkins,of the Dis- trict Supreme Court ruled that the Government had sought to charge two offenses through a single indictment of seven men allegedly interested in the $4,000,000 Willacy County, Tex., irrigation project. This grouping of charges, Adkins ruled, could mot be done. Secretary Ickes, saying P. W. A. was going ahead with the project, added of the Government's try for convic- tion: “I suppose they submitted their strongest case.” Engineer Among Seven Named. Judge Adkins held that besides charging all seven with conspiracy to defraud, the indictment also charged six conspired to influence Oldberg to be unfaithful to his official duties. These constituted two separate charges, the justice held. Substitute Plan Charged. The Government contended that after plans were completed for a gravity canal the defendants sought to substitute a pressure system through a redwood pipeline. It alleged some of the defendants were interested in the California redwood industry. Defendants’ attorneys contended the indictment did not set forth facts to support any conspiracy charge. Jus- tice Adkins did not pass on this con- tention, but said he thought it “very doubtful whether either of what I call the separate charges sufficiently de- scribes a conspiracy to defraud the United States.” Sesoageaani, Band Players Save Ship. A life-boat call interrupted a Salva- tion Army service at Hythe, England, when the fishing boat Enterprise was seen to be in distress. Most of the life- boat crew are members of the Salva- tion Army Band, and immediately the signal was heard they put down their instruments and rushed to the station. I will get you if you don’t look out. England has its C. I. D, Russia had its O. G. P. U. and now America has its F. B. I. England’s C. I. D, as every crim- inal in Europe knows, is the criminal investigation departmeat of Scotland Yard. Russia’s secret service was known by its initials, “O-Gay-Pay- Oo.” Uncle Sam's F. B. I. is the Federal Bureau of Investigation—nemesis of kidnapers, bank robbers and other desperadoes. ‘The underworld for some time has called the bureau’s agents “G-men,” and Hollywood has helped to popu- larize the term—although the Depart- ment of Justice ignores the nickname a8 too undignified. Recently, according to J. Edgar Hoover, director of the bureau, the gangsters have been referring to the Federal Bureau of Investigation by its initials. A change to the initials has been noted by investigators. ‘The use of “G-men” to designate special agents of the bureau first came to official notice of the agency when “Machine Gun” Kelly was captured in a Memphis hideout after he had participated in the Urschel kidnaping. As he stood with arms upraised in the dark corridor of & rooming house which agents and police had raided the boastful Kelly was asked why he did not use a gun which lay on a bu- reau. “The G-men had me covered,” he replied, poignantly. ‘The G, it was explained, stood for “Government.” Incidentally, the abbreviated desig- nations for the bureau are a godsend to headline writers. “G-men” and “F. Under the watchful eye of & deputy United States marshal, representa- tives of the Holbrook Dairy Farms of Hyattsville yesterday afternoon re- moved several thousand of their empty milk bottles from a building adjoin- ing the garage of the Chestnut Farms- Chevy Chase Dairy in the 3200 block of N street. In & suit of replevin filed in Mu- nicipal Court here, the Holbrook con- cern sought return of 15,000 bottles. No figure on the number actually found in the building could be ob- tained this morning, although a rep- resentative of the Holbrook company keeping & tally yesterday afternoon said that racks containing more than 3,000 bottles had been removed up to 3 o’'clock. E. N.
