TALLAHASSE, Fla., December 24— An opinion that dead men may be sued for tma‘:s in Florida was handed down by the State Supreme Court yes- terday in passiug on a sult growing oat of the bombing of a residence. J. L. Waller sought $50,000 damages from the estate of 'John Hodasz, de- ceased. Waller claimed that Hodasz bombed his residence on April 24, 1930, damaging the to the extent of $3,000 and causing Mrs. Waller to lose one leg, one eye and the use of her right hand and arm. Hodasz died shortly after the bombing, according to the record. which did not ascribe a motive for the deed. In the court’s principal opinion, Asso- clate Justice Fred H. ROCKVILLE, Md, December 24.— The act of the Legislature of 1931 authorizing the Governor to appoint & police justice for the town of Takoma Park, Md., was declared unconstitutional in an opinion handed down by Judge Robert B. Peter in the Circuit Court here yesterday afternoon. “The decision was rendered in the case of Reuben D. Day of Takoma Park, who was recently sentenced by Justice A. L. Wilson, who presides in the Takoma Park Police Court and who was appointed under the act referred to, to pay & fine of $100 and costs and to serve six months in the county iail for violation of an automobile regula- tion, Habeas Corpus Instituted. Through the Rockville law firm of Whiteford & Cissel, habeas corpus pro- ceedings were instituted for Day's re- lease and on Monday the case was argued before Judge Peter by Attorney Joseph C. Cissel, representing Day, and State's Attorney Stedman Prescott on | behalf of the State. It was contended by Attorney Cissel that inasmuch as the constitution of | Maryland vests judicial powers only in the Court of Appeals, circult courts, orphans’ courts and justices of the peace, the legislative act complained of was unconstitutional in that it simply appointment of a Park” and did not specify that he first be made a justice of the peace. Judge Peter held in his decision that, “as the constitution does not enumer- ate police justices among the officers in whom judicial power of the State is vested, in’ my opinion that jurisdiction could not be constitutionally conferred upon the officer appointed under the Day's discharge was ordered. OLNEY, Md., December 24.—Louis M. Henley, 67, gardener at the Mont- gomery County General Hospital, near here, was fatally injured when struck by an automobile in front of the hos- pital early last evening. He had just received a package from a Washington - Baltimore bus _and started back to the hospital when he was run_down by an auto driven by | Andrew J. Boyd of Olney. He was car- B ried into the hospital, where his death occurred. He sustained a fractured skull. County Policeman Paul Watkins made an investigation and preferred a charge of manslaughter against Boyd, who was released on $500 bond for his appearance in the Police Court here on January 9 for a preliminary hearing. Henley was a life-long resident of the county. He is survived by his widow, Mrs. Lydia Henley. His body is at the funeral home of W. Reuben Pumphrey, Rockville. DR. CHARLES T.
