By the Associated Pres, LOS ANOELB September 18.—At- torneys in the second-degree murder, trial “of Mrs. Lois Pantages today awaited Judge Carlos S. Hardy's de- fon on the defense's plea ior admis- sion of evidence, which, it was promised, would show Juro Rokumoto, Japanese gardener, dled of asphyxiation rather than injuries received in a collision be- tween his motor car and that of the thuler magnate’s wife. n arguments on the plea yesterday dlmng which the jury was absent from the courtroom, ‘the defense contention that the annmne dled of asphyxiation while undergoin, ration was met by the prosecuti un wnh the statement that the plea was immaterial as the operation was necessary because of Ro-~ kumoto's injuries. Will Call Physicians. ‘The argument began after Mrs. Pantages was excused from the stand, with the announcement by Max Steuer, chief counsel for the defense, that he would call witnesses to show the opera- tion during which Rokumoto died was unnecessary, and the man “was &s- phyxiated by an anaesthethic given him.” Steuer said the “hub upon which this case turns is the cause of Roku- moto's death, and the defense was ready to prove: “The operation, made against Roku- moto’s wishes, was unnecessary, and he was suffering no shock from accident injuries at the time. Rokumoto died of asphyxiation by the anaesthetic given him, and no anaesthetic should have been given him at the time.” Steuer said he had five physiclans ready to testify. Denies She Was Drunk. Mrs, Pantages denied prosecution al- legations she was intoxicated and drove to the left side of Sunset Boulevard into Rokumoto’s car. She sald “I had not had a drink of any intoxicating liquor that day, and I tried so hard to miss Rokumoto's automobile when he turned in front of me.” She added another automobile forced her to the wrong side of-the street. At the close of the session, Judge Hardy sald his investigation had proved remarks made by Rev. R. P. Shuler ovs his radio last Sunday that the Pantag: jury was hung before a line of testi- mony was taken were unwarranted, un- proved and without foundation. A com- mittee of three appointed by the Los Angeles County Bar Association handed its findings to Judge Hardy. The com- mittee stated no evidence of corruption had been found. 'BARLOW GIVEN WEEK | TO PLEAD IN HAVANA Is Expected to Send Washing- ton Attorney to Cuba, By the Associated Press. HAVANA, September 18.—Joseph E. Barlow, American resident of Hayana who has made a $9,000,000 claim against the Cuban government for al- leged confiscation of properties, yester- | day was granted an extension of one | week in which to appear in the Court of Instruction here on criminsl charges. ‘The charge, brought by Senora Vi- centa Gomez on alleged fraudulent sale Barlow’s arrest and imprisonment here two weeks ago. According to Mr. Bar- low, it was to have been changed into a civil case and then thrown out of court. Mr. Barlow, who returned to Wash- ington shortly after his arrest and im- prisonment in Principe Fortress, “among lunatics and lepers,” he said, recently informed the American State Depart- ment that Cuban courts ordered his penalty of defaulting a $500 bond and becoming a fugitive from justice. In his report to the State Department he requested that the Cuban court post- pone hearing until he could return to Havana. Reports from Washington indicate, however, that Mr. Barlow does not contemplate returning here to answer the charge, but that he is sending his attorneys, Edward M. Foristel of St. Louis and Thomas C. Bradley of ‘Washington. The Gomez charge claims that Mr. Barlow sold a plece of land to which he did not deliver title. COMING TO WASHINGTON.
