By the Assoviated Press NEW YORK. August 1.—The Federal grand jury in Brooklyn. which has been delving into the affairs of the late John | M. Phillips, sewer pipe dealer, vesterday requested that the circumstances of Phillips’ death at Atlantic City be re- ferred to the New Jersey authorities ior their investigation and consideration Phillips, whoss name figured promi-| nently in the inquiry into alleged $16.- | 000,000 Queens sewer graft. and who| was under Federal indictment for fail-| ure to file inctme tax returns, died July | 3. At the time of his death acute ap- pendicitis was given as the cause. Later 1t was said he had succumbed to a liver disorder and alcoholism Although the exact nature of the evi- dence offered before the grand jury which prompted the request for an in- vestigation of Phillips’ death was not | made public, it was said one witness had | expressed skepticism concerning the an- | nounced ceuses of the pipe dealer's death. The grand jury also recommended | that the intelligence unit of the Treas- rv Depertment investigate the disap- earance of two large bundles which were withdrawn from Phillips’ safe de- posit box in the Bay of Biscayne Bank at Miami, Fla. June 21. while Phillip: was in Pederal Court answering charges of income tax fraud.
