Doheny of Lot Angeies who were acquitted on la charge of conspiracy to defraud the Government in conne: with the Hills, California N Teserve lease. The proceedings will be held in the same room as the Fall Doheny case. The case to go on trial tomorrow gifferent from that which the Supreme Court disposed of last Monday, in that the highest court was concerned with a civil suit on the part of the Government to cancel the lease and regain possession of the Teapot Dome oil reserve and not seek punishment for any alleged offenders. The case was decided on the proponderance of evidence and no consideratior was given to & charge of bribery. Money Involved in t. In the eriminal proceeding ever, the question of mone form of Liberty bonds, passing from Sinclair to Fall, following the leas as alleged by the Government, plays an important role, but proof must be established by the Government on the entira case (o the satisfaction of a jury bevond a reasonable- doubt. The trial tomorrow is the second of four criminel suits instituted by the Government as the result of the in- quiry into the leases. In the first, held here al Fall and Edward L. TDoheny were acquitted of the charge of conspir . The third and fourth trials are still fo come. In one Fall faces a charge of bribery and the bribery, accuses Doheny. 3 From the standpoint of .the public and the legal profession, interest in tomorrow’s trial will center around the appearance or non-appearance of one of the Government’s witnesses, H. M. Blackmer, who at the time of the Teapot Dome lease was chair- man of the board of the Midwest Refining Co., a subsidimy of the Standard Oil Co. of Indiana. He and | James E. O'Neil, president of the Prairie Oil and Gas Co. at the time the lease was signed, went to Furope several years ago‘and have remained there ever since, as far as Jearned here. Many efforts were made 10 serve subpoenas on fhem. and while Blackmer was served t hy an American consul, O'Neil so far has not been served. The Government has desired their testimony, it is understood, in con- nection with the evidence relating to the Liberty Bonds and on two occa- sions postponement of the trial was asked and granted in the expectation that the two witnesses would return to this country. Should Blackmer fail to appear to- morrow in answer to the subpoena, he will be dealt with under the Walsh act in this manner: The Government coun- ®el will give proof of the service of the subpoena and proof of the aulc on the part of Blackmer.
