Expressing the opinion that few cor- porations had diverted accumulated surplus profits to avoid taxation, Sec- retary Mellon said yesterday that the investigation of such alleged violations begun sometime ago at the direction of Congress still was under way. A certain surplus is necessary in many lines of business, the Secretary said, and the law does not mean that corporations in the usual course of their business must distribute all their earnings. The law is intended only to prevent the use of the corporate form of busi- PO lon’s opinion, and it is for cases of the latter type for which the Treasu searching.
