Wilson. AS SUIT ADVANGES Countess Listens to Her Wit- ness Tell of Alleged Waste * on Wyoming Ranch. By the Associated Press. CHICAGO, Jatuary 8.-The Count- ess of Suffolk and Berks, nee Daisy Leiter, listened with apparent interest vesterday to the cross-examination of one of her witnesses, N. V. Kurtz, Wyoming reclamation engineer. But the session proved so listless to her brother, Joseph Leiter, whom she seeks to oust as a co-trustee of their father’s estate, that he dozed and for a time fell asleep. Kurtz several weeks ago testified In support of one of Lady Suffolk’s allegations that Leiter wasted hun- dreds of thousands of dollars in devel- oping the Wyoming ranch properties. Much of yesterday, under questioning by Leiter's counsel, Kurtz was point- ing out various distances upon a map of the region surrounding the Leliter ranch. It was estimated by attorneys that the protracted suit would require an additional five weeks, one week for testimony and four weeks for argu- ments. A new suit for $10,000 was filed vesterday against Leiter. Attorneys filing the suit said the $10,000 represented the unpaid bal- ance on a $30,916 judgment won against Leiter in New York for attorneys’ fees. ‘The bill of ‘the sult avers that the judgment was secured December 31, 1925, and that Leiter has refused to complete his payments. The services rendered Leiter were not in connec- tion with the estate controversy. COURT CUTS $6,700 FROM DAMAGE VERDICT Orders Reduction in Amount Awarded Man and Wife in Suit Against C. & O. The Chesapeake and Ohio Railway Co. has been saved $6,700 by the action of Justice Frederick L. Siddons of the District Supreme Court. The justice "directed Walter Cheyne and Milton Cheyne, to give up that amount of verdicts recently ren- dered in their favor by a jury for in- juries received by Mrs. Cheyne when put off a train at a desolate place in Virginia in September, 1924. Unless the plaintiffs consent to give up that portion of the verdict the company will be granted a new trial. Justice Siddons held the verdicts to be exces- sive in view of the injuries. Mrs. Cheyne had been awarded $10,000, and must now accept $5,000, for her injuries. The husband had been granted $3,051 for loss of his wife's services and the expenses incl- dent to her illness. He is required to remit $1,700 of that amount. The company will now have to pay only $6.351 instead of $13.051.
