Up to date their salaries always have _|been taxed under the Federal income tax law. This covers both the 435 members, of the House and the 96 members of the Senate. It has been held regularly in the past that Sena- tors and Representatives are exempt from the payment of State income taxes in the salaries pald them by the KFederal Government. The theory has been that they are not State of- ficials in the States where the State income tax laws provide for taxation of State officials on the salaries paid them by the States. Reciprocity in Effect. There has been a kind of reciprocity between the States and the Federal ; | Government in this matter of income taxation on State and Federal salaries. The States which have income tax laws have refrained from levying against Federal salaries, and the Fed. eral Government has * not levied against the State salarfes. in many of the States today there is Forida has put a provision in its constitution pro- viding against the enactment of in- come and inheritance tax laws in the State. It may be argued that the income tax laws, State and Federal, run against the emoluments paid by the Federal Government and by the States, and that, since the Federal Govern: ment puts up the money for the sal- aries of Representatives and Senators, s are held to be State officers, under the letter of the law, will they be required to pay the Federal income tax? Sena- tor Smoot of Utah, chairman of the Senate finance committee, and Senator Walsh of Montana are among those who believe that under a ruling that Senators were State officers the Fed eral tax could not be levied against thelr salaries. The same would apply, of course. to members of the House. | They would not be exempt, however, from the payment of income taxes on income other than their salaries from the Government. U. S. Stands to Lose. The salary of members of the Sen ate und House is $10,000 a vear. If the Government is unable to collect an income tax against their salaries, on the ground they are State officers, it stands to lose a neat little sum. Furthermore, what becomes of the taxes which members of Congress have been paying’on their salarfes for the last 12 years? Will the Govern- ment have to disgorge them? The exemption of salaries of State officials from Federal income tax also runs to salaries paid municipal ofti- cers and employes, except in the case of the officers and emploves of the | District of Columbia, who are espe- clally covered by the income tax law.
