~ 10 EXWARSAESHEAD ICLEARED BY JDGE fiailey Declares Morse Is t Completely Vindicated 2 by Evidence. NO PROOF OF HIS GUILT fittomey Hogan Roundly Scores § Naming of Client by Justice : 1 Department. ! Justice Jennings Bailey, presiding t. Criminal Division 2 of the District Bupreme Court, today completely ex- @ncrated Ernest C. Morse of Cincin- #ati, Ohio, who held the position of @iirector of sales of the War Depart- fnent under Newton D. Baker, Secre- Rary of War, of any complicity in #he alleged lumber fraud conspiracy by which the United States is said #0 have been mulcted for more than #1,000,000. ; The court directed a verdict of ac- quittal on the motion of Attorney rank J. Hogan, at the completion { the argument of John J. Parker, hief counsel for the prosecution, fvithout a reply from Morse's lawyer. Reply arguments to the govern- fment’s contention by counsel Tor the ve other defendants are still in rogress. The jury had been respited until tomorrow. In Line of Duty. { Justice Bailey declared that as to 4he defendant Morse there was no £vidence to show that any act of his was not for the best interest of the overnment, as he thought. There fias Do Prodt. the court said: of ‘any 3 oing on the part of Morse hat he had any association or col- STUDEBAKER Just Drive It; That’s All laboration with Philips & Stephens, and that everything done by him was in the line of his official duties. There was not the slightest evidence of any corruption on his part, the court declared, and at the proper time he would direct a verdict of not gullty be returned by the jury as to Morse. The trial was halted while the oth- er lawyers crowded about Morse and his counsel, Attorneys Frank J. Ho- gand and William E. Leahy, and ex- tended congratulations to them amd to their client. Morse then left the courtroom with his lawyers and. has- tening to a telephone, notified his wife of the good news of his ac- quittal. Declares Morse Vindicated. Attorney Frank J. Hogan was strong in his denunciation of the ac- tion of the Department of Justice in including Morse among those named as conspirators in the lumber case, and declrred Morse had been com- pletely vindicated on the merits of the case. Mr. Hogan pointed out that this is the second time this year that a United States judge had declared that there was Jjustification for the prosecution of Morse. The lawyer referred to the decision of the court in the harness case in West Virginia, where Morse was also exonerated. Mr. Hogan asserted that the inclusion of the name of Morse in the indict- ments was purely political, and laid the blame on former Representative Graham of Ohio.
