LCC.LFTS AN | ON RAL MERGER Southern- Pacific to Retain Central Pacific Control ‘If Court Ratifies. FORBIDDEN BY DECISION| Commission Declares Nation's Old Policy Is Reversed by Passage of Transportation Act. ®The application of the Southern Pa- cific company to retain its present control of the Central Pacific railroad by ownership of its stock and lease of its lines were granted Saturday in full by a decision of the Interstate Commerce Commission. Although the supreme court in 1922, at the end of eleven years of litiga- tion over the existing merger of the roads, held them to be a combination in restraint of competition and ordered them separated, the commis- sion—with but one member dissent- ing—declared their maintained union ‘was necessary in the interests of the western states they traverse and the country as a whole. Further, the majority declared, the former poliey of the nation in de- manding maintenance of comperition above all other things in transpor- tation service, had been reversed by the congressional enactment of the transportation act of 1920, permitting general consolidation of railroads under government supervision. On this ground the maintenance of the merger of the two roads., uotwith- standing the court's decree, was de- claped to be ‘legally authorized, and advisable in view of public neces . The opinion point out, howe! that the conclusions of the commis sion would be subject to review by the courts before they could become effective. . McChord's Opinion. Commissioner McChord, in com- | plete cissent from the view of his associates, declared the “findings of the majority to the will of Congress as expressed in the legislative act which conferred the powers invoked in this case.” With Commissioner Camp- bell, who entered a partially con- curring opinion. he concluded that the Central Pacific Company. by it: | peculiar nature as a corporation,; could not legally lease its lines ta the Southern Pacific without special federal legislation. E. Septman, post office inspector of Washington, arrested Cyrus W. H. Briddell, pastor of three African Methodist Episcopal churches on Kent Island. The ~thirty-six-year-old negro preacher signed a confession of his guilt, and was removed to Balti- more to be tried in the federal courts. Four vears ago Briddell started the first of his series of letters. They were mafled from Baltimore and always signed by fictitious names.
