ARGUMENT ENDED IN THEATER TRIAL Knickerbocker Men’s Attor- ney will Reply o Prosecutors. “I bope I shall never live to see the day when any court will declare as a matter of law that, on the facts of this case, there was no criminal re- sponsibility.”” With this statement Assistant United States Attorney O'Leary today concluded before Jus- tice Siddons In Criminal Division 2 his argument in defense of the in- dictment which charges five men with manslaughter in connection with the death of ninety-seven patrons of the Knickerbocker Theater, caused by the fall of the roof of the building’ Jan- uary 28 last. Mr. O'Leary and United States At- torncy Gordon completed the govern- ment’s side of the argument today. Each of the counsel for the five ac- cused men will be given an oppor- tunity to reply to the arguments of the prosecutors. Rererring to the claim of the de fendants that if the indictment is sus. tained it will have the effect of stop ping building operations in this Dis trict, Mr. O’Leary sald: “I cannot believe that builders gen- erally in this District are guilty of the gross negligence admitted by this demurrer, but what defendants’ counsel say is true, then it is high time that a stop be put to building operations which ignore the very purpose for which governments are ordained and established, namely, I‘lhe‘ security of the llves of the pub- Time to Break Precedent. The principles of a Tacna-Arica arbitration formula finally accepted by both sides, the Chilean and Peru- vian delegates to the Washington conference today turned their atten- tion to collaterial decisions which are necessary to complete their agreement. & One of the subjects yet to be finally passed upon was the exact wording of the formula, but no one on either delegation looked forward to much discussion over_phraseology. It was indicated, in fact, that in their informal discussions the plenipoten- tiaries already had given coneiderable attention to that point and had estab- lished a clear understanding of the torm to be adopted. > - Steps to complete formally the agreement as t the substance of the formula were taken during the day by Chilean Ambassador Mathieu, who had an appointment to see Secretary Hughes and accept on behalf of the Chilean government the final terms of the compromise agreement. These terms included a provision for an exercise of American “good offices” for ‘a settlement in case no plebi- scite is held In the disputed territory. Joint Meeting Tomerrow. Meantime others in the Chilean and Peruvian groups were at work on other minor points remaining at is- sue, and it was planned to hold a joint meeting of the two delegations tomorrow to begin preparation of the protocol which is to embody the- con- ference results. Most. predictions in conference circles were that a week or ten days more would be required lodhrlng the negotiations finally to an end. 3 s The arbitration agreement, assured late Saturday, when Chile accepted the American compromise proposal as modified at the request of Peru, was hailed by the plenipotentiaries of both governments last night as a long forward step in Latin American amity. By removing an irritation which " has _ estranged Santiago and Lima for the past forty years, the settlement was regarded among Chileans and Peruvians alike as meaning not only a new Chilean- Peruvian accord, but as exercising a beneficent influence that will be felt throughout the length and breadth of South America.
