APPEAL FROM DECISION. Commissioners Dissatisfled With Decision in Condemnation Case. The District Commissioners today noted an' appeal from the decision of Justice Bailey of the District Supreme Court dismissing th® céndemnation proceedings for the widening of Ben- ning road from 15th street northeast to Oklahoma avenue. The condemna- tion proceeding has been in the court for six years. The court sustained the motion of Attorney W. C. Sullivan for the dropping of the proceedings on the point that the dedication of land in connection _with_ the subdivision known as East Side Park did not conform to the law in that no agree- ment was shown to maintain a park- ing space under the conmtrol of the District government in addition to the land dedicated for the widening of the roadway.
