The case involved a controversy over the amount of duty on an invoice of tobacco, and was not impor- tant In itself. Right to Exclusive Franchise. In the case of the Detroit Citizens’ Strset Railway Company against the Detroit rail- way and the city of Detroit, which has been pending in the court for some time, the court affirmed the decision of the state court adverse to the former company. The case was appealed from the decision of the supreme court of the state of Michigan, and involved th2 right of the Detroit city coun- cil to grant an exclusive franchise to lay Street car tracks in that city. In 1862 an ordinance was passed giving to the Detroit City Railway Company, of which the De- troit Citizens’ company is the successor, the right to lay railways in streets voted by the council to the exclusion of all other companies. In 1879 this right was extended for thirty years In 1894 the council passed an ordinance giving the Detroit railway the right to lay tracks on the same streets al- ready occupied by the lines of th> other company. The old company then brought suit to restrain the new organization, on the ground that this ordinance impaired the validity of its contract with the city. ‘The decision was handed down by Justice ‘MeKenna, and was adv=rse to the claim of exclusive right, sustaining the decision of the Michigan court. The court in two instances decided the question of the right of the owners of a mineral vein to follow the vein outside the territory covered by the surface area of lo- cation, the opinion being by Justice Brew- er. The first of these cases was that of the Del Monte Mining Company against the Last Chance Mining Company, the property involved being located in tha Sunnyside dis- trict, in Mineral county, Colorado. ‘The other mining case was that of W. A. Clark against William Fitzgerald and oth- ers, covering Montana mines. Validity of Bonds. Justice Brewer handed down the opinion in the case of the Providant Life and Trust Cempany of Philadelphia against the coun- ty of Mercer, in the state of Kentucky, ap- pealed from the United States circuit court of appeals for the sixth circuit. ‘The case involved the validity of certain bonds issued by the county in aid of the Louisville Southern Railway Company. Af- ter paying interest on the bonds for three and a half years the county repudiated them, on the ground thet ths road had not cemplied with the terms of the law under which the authority was granted to the county to issue the bonds. The case turned upon the question of the meaning of th> word “through.” While the road was built into the county, it failed to cross it to the extent of two miles. A clause in the law Frovided that the obligations should not be cénsidered valid until “th: road shall haye been completed through the county.” In rendering his opinion Justice Brewer held that the word as here tised did not neces- sarily mean that the read should traverse the county from end to end. He reached the conclusion that the road had earned the bonds, and therefore af- firmed the opinion of the circuit court of appeals. —__- e+ —____. ARMY ORDERS. A dispateh from Chicago last night says: The formal announcement of the engage- ment of Miss Laura Williams, daughter of Mr. and Mrs. Norman Williams of Chica- so, and granddaughter of the late Judge John Dean Caton, to Major General Wesley Merritt, military governor of the Philippine Islands, was made today. Miss Williams is about twenty-two years old, a brunette, graceful and petite, but of striking appearance, with jet black hair and eyes, and brilliant coloring. She has received much attention here and abroad, especially in London, where she was the guest of Robert T. Lincoln, when he was the representative of this country at the court of St. James. She was presented at the queen's drawing room with Miss Lin- coln. Norraan Williams has for a number of years been one of the well-known figures in Chicago legal and financial circles. General Merritt w born in Iliaois, and is a graduate of West Point. He entered the war directly after gradudtion, in 1861. In April, 1863, he appointed brigadier sSeneral, and his services throughout the War were of the most distinguished kind. Cruiser Off Cuban Const. A dispatch from Key West last night says: The officers of one of the United States cruisers, which arrived here today, say that while off Cape San Antonio (the Western extremity of Cuba) yesterday af- teynoon a terrific explosion was heard from the direction of the shore, but apparently nnany miles away. There was an upheaval of water all about the ship and the cruiser herself vibrated with the shock from stem to stern. Many are inclined to think that the phenomenon was an serthqaah .. There are no batteries near aoe o Cape San Antonio to account for a detonation of such volume, and it is thought that if any naval Gisaster had occurred news of it would have reached here. Judge Locke, in the United States dis- trict court, today heard arguments in three of the-most important cases, those of the Buena Ventura, Miguel Jover and Catalina. A number of counsel appeared, and it was contended on an extended citation of au- thorities that all three vessels should be condemned as lawful prizes. Arguments against this contention were made by an array of counsel representing the various interests, including the owners of the vessels and their cargoes. Judge Locke. reserved decision.
