The District Attorney Indicates an Early Trinl—A Bitter Legal Contest Expected Between Counsel. Dennis J. Canty was today arra‘gaed he- fore Chief Jusiice Bingham in Criminal Court No. 1 under the indictment reported against him last week charging that the morning of the 15th instant he murdered George .M. Rye. In tones perfectly calm Centy replied “Not guilty” to the cus- tomary query of Clerk Gatley at the con- ciwsion of reading of the presentmen:. District At:orney Henry E. Davis then expiained that the maiter would be again cailed to the atiention of the court within the next few days, for the purpose of fix- ing a Gay fo= the trial. ‘The arraignment occupied Icss than five minutes. As stated ycsierday in The Star, the expectation is that the trial of Canty will begin not later than the 20ih of April, and possibly as early as the 11th proxime. Attorney A. Worthington sat beside Canty in court today, District Attorney Davis and Assistant District Attorney Shil- lagton representing the government. Canty, as usual, was well dressed. He lis- tened intcntly to the reading of the indict- ment and displayed no signs of unusual cencern. Canty Meets His Mother. The well-known prisoner was driven from the jail to the court house in a closed coupe. He was accompanied by Deputy Marshal Cusick. In the witness room, ad- joining Criminal Covrt No. 1, he found awaiting him his aged mother and his sis- ter. It was the first meeting, it is under- stcod, between Canty and his mother since before tne meident that resulted in the death of Rye. An affecting embrace between the two was interrupted by a call to the court roem. After the arraignment Canty re- turned to the witness room, where he en- gaged im earnest conversation with several friends. There he was joined by his fath- 4 er-in-law, Mr. Hussey, with whom he con- versed quietly for several minutes. The party then proceeded to the sidewalk. Kissing his mother and sister, Canty en- tered the coupe and was driven away in the direction of the jail, the deputy mar- shal, of course, being a passenger in the vehicle. Canty’s Eminent Counsel. The trial of Canty promises to be one of the. most bitterly fought criminal en- gegements in the history of the local courts. Immediately after the shooting of Rye Mr. A. S. Worthington, conceded to be one of the ablest practitioners at the Dis- trict bar, was retained to defend Canty. A Star reporter learned today, however, that Mr. Worthington will be assisted by an unusually formidable array of legal talent. Judge Jeremiah Wilson, who has figured prominently in the majority of criminal hearings of prominence in this jurisdiction, is now associated in the Canty case with Mr. Worthington, as are aleo Mr. John C. Heald, Mr. Worthington’s law partner, and Messrs. Thompson and Frailey. District Attorrey Davis and Assistant District Attorney Shillington will look after the prosecution. The sentiment at the city hall building seems to be that the governmeat could not be more ably rep- resented. ———— CONTROL OF PARKINGS. Mr. Ross Describes the Situation to the Senate. Commissioner Ross has written to Sena- tor McMillan in regard to Senate bill 2026 te vest in the Commissioners control of the street parkings. Mr. Ross says: “I have before me complaints with re- gard to the occupation of parking spaces by barrels, boxes and rubbish, which were referred to the police department for ac- tion, and on which the lieutenant reports that by decision of the Court of Appeals in Libbey’s case the offender cannot be Frosecuted for occupying the parkings for rrivate purposes: also complaints with re- gards to the storing of stone on parking space, as to which the same situation is repcrted to exist. There are, too, numerous requests for the change of terraces and for paving parkings in front of stores end premises used for business purposes, ete. You can readily see that with no one charged with the duty of naving obstruc- ticns removed with power of enforcing the same in seme court the situation may be, indeed, deplorable.” Mr. Ross says that in the case of the District of Columbia against Libbey the Ccurt of Appeals held that the power wus vested in the Secretary of the Interior or the superintendent of public buildings and grcunds. Mr. Ross incloses with his letter a ccmmunication from the Secretary of the Interior, in which the latter gives his yritten approval of the proposed legisla- tion contained in the Senate bill under consideration. Mr. Ross says the Commissioners will be pleased to have the authority for the con- trol of street parkings vested somewhere, and tf it does not seem appropriate to piace it in the hands of the Commissioners, he says it would be better to vest the scle responsibility and authority in either the Secretary of the Interior or the super- intendent of public buildings and grounds. —————— PERMIT REFUSED. Commissioners Will Not Experiment With the Lake Pavement. Mr. Wilmot Lake, several weeks ago,, quested the District Commissioners to mit him to superintend the laying of a sys- tem of asphalt pavement of his own inven- tion, he agreeing to put the District to no expense in his effort to demonstrate the claimed superiority of his invention.. The Commissioners have refused to grant Mr. Lake's request. ‘They explain that all work of asphalt pav- ing done by the District is, in pursuance of law, done under contract with a five- year guarantee by the contractor concern- ing the character of the pavement, and they do not see how they can require a contractor to accept the services, as super- intendent, of any person, even if such serv- ices be voluntary, and the person in ques- tion is thoroughly competent, as they be- lleve their power extends only to the proper inspection of the work, and the contractor, under the law, is entitled to the selection of his entire working and engineering force. The Commissioners also believe there would be considerable difficulty in getting the contractors to guarantee a pavement which would be purely experimental; but if any contractor desires to lay a pavement according to Mr. Lake's method ana patent, and will give the usual guarantee, the mat- ter can. then be properly taken up. The question {s thought by the Commissioners to be purely a business one with the Dis- trict, and they feel that they should not be called upon to waive a guarantee or any other of the usual safeguards applied to street pavements, and that neither Mr. Lake's method nor any other untried one should be adopted without full protection to the District and the public. es GEMS OF THE WEST. Feature of the Mining Display at the Omaha Exposition. Dr. David T. Day of the United States geological survey has been asked by the Trans-Mississippi Exposition Company to direct the mining branch of the exposition. Dr. Day filled a similar position at. the cotton states and international exposition at Atlanta. He has just returned from a visit to Omaha, and is full of praise for the exposition which will open there June 1. He thinks that in no exposition has there been shown more artistic skill and practical thought in the designing of the buildings and in the way they are grouped to afford the most favorable views of the exposition as a whole and to admit of see- ing ‘the exhibits with the least, possible walking. Bicycling has become a popular exercise and un- dcubtedly furnishes, in addition to muscular de- velopment, great exhilaration. _ Dumb belis, if properly used, strengthen the mesctes of the arms and incidentally, those of the bedy and legs. They a!so expand the chest and brouden the shoulders. After exercise a cool shower spray or bath should be taken, not to Iast more than one or two minutes and should be followed by a brisk rub to tone up the system: @d encourizge the circulation of the blocd. Some pure stimulant .chould also be used. Duffy's Pure Malt Whiskey is used by Prominent athletes for this purzose tnd is highly recommended. It should be noted, however, that only a pure and medicinal malt like Duffy's will be of serv- ice. A central feature will be a collection of the gems of the west, including the best exhibition that has yet been made of the beautiful turquoise from New Mexico. A section will be devoted to the Idaho opals, which equal in beauty and value those of Hungary and Queensland. Lately, blue sapphires of the finest color have been added to the lighter colored ones formerly found in Montana. These will add to the beautiful tints of the gem section. A few diamonds will be shown which were found in Wisconsin, and Utah and Colorado will furnish topaz, some of it of a beautiful pink shade. In California, magnificent quartz crystals nave lately been found, which will be added to the collection. Then there will be garnets from New Mex- ico and Alaska, and variscite, a new semi- precious stone from Utah. ‘The gold case will have a great supply of gold nuggets from Alaska and of crys- tallized gold from Colorado.
