One case of housebreakirg and six cases of larceny were reported to police head- quarters today, giving the detectives plenty of work todo. The case of housebreaking occurred Thursday night at the shoe shop of Max Sharkowitz, No. 328 I street south- east. His shop window was forced open about midnight and twenty pairs of shoes were stolen. Thomas Mutchler reports stolen from his Rouse in the county on the Ridge road Thursday three dresses and several pillow shams. Javin Jarboe —_ the theft of a p< cketbook, containing $9. The money was stelen from his room at No. 1254 3d street southeast. A complaint made by Albert Diehle, who lives at New Jersey avenue and D street, involves the theft of a gold watch and $20 in cash. RULING ON: OFFICE: TENURE Civil Service Reform League at Issue With Point Raised by the Collect of ternal Revenue in Virginia— The De; aty CoHectors. er The National Civil Service Reform League is making a vigorous fight against the con- tention of the deputy commissioner of in- ternal revenue that the terms of internal revenue deputies expire with those of the collectors who appointed them, and that accordingly the standing of such employes is not affected by the civil service rules. This point was first raised by Collector Brady at Richmond, Va. Mr. Brady on assuming office September 1 notified a large proportion of the subordinate em- ployes that their services would be no longer required. He claimed subsequently that he had not removed these persons, but that he had merely declined to “‘re- appoint” them. The displaced deputies con- tested this construction, and claimed the Protection guaranteed by the executive order of July last, requiring that reasons for removal shall be stated in writing and &n opportunity afforded to the person re- moved to make a defense. The point made by Mr. Brady is upheld by Deputy Commis- sioner Wilson, but not as yet by the Secre- tary of the Treasury. It is understood that the department is still considering the novel question raised, but that some decision may shortly be ex- pected. In view of the fact that there are numer- ous other positions in the civil service more or less analagous in character, which will be affected by the ruling in this case, the matter is viewed as of the highest im- portarce by the Civil Service Reform League. Secretary McAneny’s Views. Secretary McAneny of the league, in a letter to The Star, argues at length that the ultimate scurce of appointment in re- spect to the deputies is under the Consti- tution in the Secretary of the Treasury and not the collector; that the authority for the classification of these deputies under the civil service rules is undisputed; that the deputies have been thus classified by executive order, and that President Mc- Kinley’s rules concerning removals in the classified service apply to these officers and were intended thus to apply. “As I undersiand it,” Mr. McAneny con- tinues, “the applitation of these rules to ectual. remvvals is not disputed, the cor- tention being confined to the claim that there is a distinction between a removal and the expiration of a deputy’s term, and that his ‘term’ expires when the im- mediate superior—the collector—resigns or is removed. There seems to be a total ab- sence of authority, however, for the claim that there is a distinction between the two methods of separating the employe from the service. “The statutes clearly show and public policy certainly requires that a deputy shall hold office until his commission is re- voked in the prescribed manner. Under no provision of law does the term of a depu- ty cease with that of a collector. No such construction has hitherto been put upon the statutes, and if it were now to be ad- vanced and upheld by the courts the gen- eral effect would be serious. At each of the classified fost offices, there are a large number of employes ac ing in a fiduciary capacity who give bonds to the postmaster. These bonds are per- sonal in character, and expire with the term of the postmaster to whom they are given. Upon the advent of a new postmaster these employes may be required to give new bonds, but their status in the classified service has never been questioned, nor has it ever been contended that they go out with the postmaster under whom they have been appointed. There are numerous other instances of the sort throughout the ser- vice. The original authority for appoint- ment in the case of any of these subordin- ates is derived, however, from the head of the department, and it is so derived in the case of the internal revenue deputies. The Collector's Authority. “Section 3148 authorizes the collector to appoint as many deputies as he may think Proper, but this power is not in fact exer- cised by the collector. ‘he number of depu- ties to be employed is fixed by the ‘Treas- ury Department, with which rests the au- thority to prescribe the amount of com- pensation. The actual right to appoint is derived only from the Secretary, no matter what the language of the statute may be. That right cannot be vested by Congress in any subordinate officer in such a manner that the status of the person appointed will depend on the tenure of that subordinate officer. It would seem that the collector, in appointing, acts as the agent of the Secre- tary merely, and he is further bound, both in selecting his subordinates and in con- trolling their tenure, by the provisions of the civil service rules. “It will be highly gratifying to those who have applauded the recent admirable order of the President if such a view is upheld by the department, and if the civil service system is not permitted to be impaired, pending a possible settlement of the ques- tion at issue by the courts.” es Freeman’s Case Continued. Assistant District Attorney Mullowney today in the Police Court consented to the cortintance until the 12th instant of the hearing in the case of Howard Freeman, the colored boy arrested yestérday on a charge of assaulting two little white girls— Rena Sanger and Irene Jerdan—as reported fully in The Star. ‘The continuance was granted at the re- quest of Attorney Albert Sillers, who has been retained as counsel for Freemar:.. At- torney Sillers desires time in which to gather evidence. To a Star reporter Mr. Sillers stated that.
