Y., yesterday there appears to be a possibikty that clubs..will escape the operatiors of the Raines excise law. The case was that of the state versus the Adelphi Club of Albary for selligg Hquor without a license, and it was brought under the old excise law, the defendant “being fined $500 by the trial ccurt. Liquors, as well as other supplies, are distributed to its members upon the written order of the member at a price fixed by the officers of the club, desigred to cover the purchase price and disbursements in serving. We think that the transaction did not amount to a sale within the meaning of the statute. It was but a distribut!on among the mem- bers of the club, of the property that be- longed to them. The fact that a payment was made dees not change the character of the act, for it was the means adopted by which each member could receive his own and not that belonging to his fellow member.” Matthew Hale, counsel for the Adelphi Club, said, after-hearing the decision: “The new law distinctly levies a tax for ‘trafficking’ in lquers. This opinion dis- tinctly says that clubs do not traffic in liquors, but only distribute what is their own. The Jolly Fat Men’s Club gave their first annual smoker last night at their home, 719 6th street northwest, and a large num- ber, including members of the club and outsiders, enjoyed the hospitality of the organizaticn. Eatirg, drinking and smok- ing were indulged in urtil a late hour, dur- ing which time a varied program, consist- ing of selections on the piano and violin, vocal and whistling solos, recitations and speeches, was given. The Madrid Banjo, Guitar and Mardolin Quartet responded many times to the encores received by them. The smoker was the first of a se- ries of entertainments of this nature in- tended to be given by the club, and was in charge of Mr. Sigmund J.
