It appears that for certain internal revenue taxes, amounting to $3,463, assessed against one Snyder, the United States has a lien upon real estate in the city of New Orleans now owned by the Cotton Press Company, they having bought it from Snyder after the lien attached. In consideration of a release of the lien, the Cotton Press Company sub- mitted an offer to pay $s), together with all costs and expenses, and the United States district attorney and the solicitor of the treasury recommended its acceptance. The question having gone to the Department of Justice for final determination, it was there decided by the solicitor general that the law “does not authorize the Secretary of the ‘Treasury to remit or release moneys due to the United States and clearly recoverable, but to ‘compromise,’ which implies a claim of doubtful recovery or enforcement. The power is strictly a fiscal one, to be exercised in ch case upon fiscal corisiderations alcne.” Inferentially, the decision holds that it is not proper to consider either equity. hardship of public policy in the determin: tion of compromise questions, the only con- dition warranting a compromise being the inability of the party to pay.
