‘12 THEY MUST ANSWER! DUFFY'S PURE Both Havemeyer and Searles Certified to the Grand Jury. 1m the Same Position as the Corres- pondenis—Senator Gorman on the Sugar Trust. The sugar investigating committee of the Senate yesterday afternoon reselved to cer- tify both Messrs. Havemcyer and Searles of the sugar trust to the grand jury for prose- eution under the same statute that is now being invoked in the cases of Correspond- ents Edwards and Shriver and Broker Chapman. Both of these witnesses refused > answer important questions of the com- mittee. Senator Allen made the motic: and, after arguments, it was adopted by the vote of 3 to 2. Senators Allen, Lodge and Davis voted aye, and Senators Gray and yy no. Mr. Allen also moved to bring witnesses before the = of the —— to be given a final chance to answer, bat this wan lost, 4 © 1, Mr. Allen casting the only affirmative vote. In arguing upon @ first proposition Senators Gray and ‘ndsay urged that the questions which Messrs. Havemeye> and Searles had re- fused to answer were not pertinent, and that a conviction under an indictment in ‘tWelr cases could not be obtained. This ‘was answered by the declaration that it ‘Was not within the jurisdiction of the com- mittee to try these cases on their merits, Dut to certify them to the proper judicial offleers whenever certain facts were found. Those facts had been found, in these in- stances, just as in the other three, and, therefore, the committee's sole duty was to certify the cases and let the court decide upon the applicability of the statute. As I recall it, nobody was satistied with the figuring of eny other, and Mr. Searles was telephoned tor to meet Senator Jones, who had special charge of the schedule, and who was very well posted upon the figures, and thereby (the thelr payimend), premises. on TUESDAY. There was nothing else in the interview.” Senator Alien put several questions to Senator Gorman about campaign contribu- | tions by the trust, but Senator Gorman in- lated that he knew of none. He said: “I never knew of any contributions being made to the democratic committee while I was connected with it, and I have been con- nected with it a great many years.
