A non-suit was ordered yesterday in the case of Walter H. Hooker against Calderon Carlisle and Leonard C. Wood, in which $25,000 was claimed because of an alleged non-performance of contract. In 1891 Wood, acting for the Mystic Shrine, offered $62,000 for the Marini Hall property, it was alleged, Hooker fepresenting that he was alone authorized to sell. Wood subse- quently ascertained that Carlisle was the agent, and that the price was but $40,000, whereupon negotiations with Hooker were broken off. The case had been called for trial several times, the plaintiff not re- sponding, and upon his failure to appear yesterday the non-suit was directed by the court. aes as Atlantic Building Company.
