Justice Jackson today rendered bis maiden opinion as a justice of the United States Su- preme Court. By the opinion the court affirmed the judgment of the Circuit Court for southern New York in the case of Passavant & Co. against the United States, involving an important question under the customs administrative act. Passavant & Co, imported some gloves which were entered at a certain valuation. Th customs officert when they appraised the gloves increased the declared value by more than 10 per cent. The importers appealed first to one of the general apprais- rs and then to the board of general ap- raisers, with the result that the cus- ms officers were each time sustained. The collector thereupon asseseed duty at 50 per cent, the rate fixed by the McKinley bill for gloves of the value found, and in ad tion levied a further duty or ity of 2 per cent of the total appraised value for each one cent of excess over entered value. The importers wished to appeal the ease to the courts and thus the question resented itself, Have the circuit courts of the United States under the provisions of the cus- tome administrative act any jurisdiction on plication of dissatiefied importers to review and reverse a decision of the board of general appraisers ascertaining and fixing the dutiable value of such goods when the board bas acted in good faith and no mis- conduct is alleged? The circuit court and this court hold that under the administrative act the findings of the board of general ap- praisers as te the dutiable value merchandise made after # full hearing are fival and conclasive and no’ reviewable by the courts. ‘The court also holds valid the penalty pro- vided where goods are appraised more than 10 per cent above the entered value. —s ease GEE ARREARS OF TAXES, Opinion of the, Attorney for the District Upon Certain Points. ‘The collector of taxes recently requested the Commissioners to get the opinion of the attor- ney for the District upon certain legal proposi- tions involving the construction of the act of February 25, 1893. ‘The questions propounded and the replies of the attorney thereto are as follows: Q. 2. “Am I to understand that this act re- fers to the act of May 6, 1890? Is the language of the bill sufficiently to admit of this construction or to me in receiving ar- rearages of taxes with 6 per centum in lieu of Mrs. Kramer had been to see him at the money order office several times. It was not uncommon for ladies to call to see the clerk. They had reported to him, the asxauits made by Kramer. He first knew Kramer on June 7, but bad seen him before and believed him to be Kramer. On Jane 7 Mrs. Kramer having been informed that Kramer was hanging about her house and she being afraid to zo out, be went with her from 1ith street to her sister's on 6th street. At the corner of 11th and H streets Mra. Kramer said, “Lord, there is Kramer.” Ther, however, went on, and at 7th and H streets Kramer over- took them and asked who he (witue@) was. Kramer enid she was his wife, and_she replied she would not live with him. An officer walked up and he placed her in the charge of an officer. KBAMER FOLLOWED HIM. Then he left and Kramer approached bim. He bad been informed by Mra. Kramer that Kramer bad threatened that there was a man going with her he intended to kill. The wit- ness asked if he would attack him. She said that Kramer would not attack him in front. Kramer came up. eaying that he would go with them. and he believed that his p shoot or stab him. It was a seven shooter. It wason the 8th of June he got the pistol and carried it then till the shooting whenever he was on the street. The next day he saw Kramer on F between 9th and 10th streets, and Kramer passed him as if he did not recognize him, but Kramer, however, foilowed him to 13th street, but did not accost him.
